Actual Title: The New York Five: Read the Unclassified Government Files on the Terrorists the White House Plans to Import into America ^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^

The Obama Administration has announced it will bring Khalid Sheik Mohammed and four of his 9/11 co-conspirators – all terrorists currently imprisoned at Guantanamo Bay — to trial in civilian courts in New York City. To read the unclassified files on these terrorists from the Director of National Intelligence (DNI) and Department of Defense (DOD), click HERE.

Also see this from Bill Kristol this morning, relaying the reaction of the sister of 9/11 victim Charles Burlingame, the pilot of American Airlines Flight 77:

Today Attorney General Eric Holder will announce that Khalid Sheikh Mohammed and several of his fellow 9/11 co-conspirators will be brought to New York City and tried in federal court. No doubt the Attorney General will invoke the phrase, ‘Swift and certain justice.’ This is a sham. There will be nothing swift and nothing certain about it.

The trial will be a travesty. The prosecutors at the Southern and Eastern Districts fought over these career-making cases like vultures at a kill. But who will be the vulture? In open court, it will be Khalid Shiek Mohammed who will hold forth, mocking his victims, exulting in the suffering of their families, ridiculing the judge, his lawyers and the American justice system, and worst of all, rallying his jihadi brothers to kill more Americans as the men and women of the US military risk their lives in the mountains of Afghanistan and the sands of Iraq. All, just blocks from where 20,000 body parts were dug out of the rubble of the Twin Towers.

Remember KSM’s famous opening line when he was grabbed in Rawalpindi? ‘I’ll talk to you guys after I get to New York and see my lawyer.’ Thanks to the Obama admnistration, it looks like he’ll get his wish. And he’ll do his best-with the help of this top-drawer lawyers and much of the media-to make the real defendants at the trial the CIA interrogators-and the American government.

How will this help achieve what our president claims he wants to achieve-‘restoring respect for America’? Is that what he really wants?

In a statement this morning, House Republican Leader John Boehner (R-OH) called the Administration’s actions “irresponsible” and commented:

These men are part of a global terrorist network dedicated to attacking America and civilization itself, and on that awful day nine years ago, they succeeded in killing nearly 3,000 innocent men, women, and children. These terrorists were already being tried by military commissions, which were specifically designed to prosecute such heinous acts. This decision is further evidence that the White House is reverting to a dangerous pre-9/11 mentality - treating terrorism as a law enforcement issue and hoping for the best. We need a real strategy for fighting and winning the war on America’s terrorist enemies that includes an effective, credible, and consistent plan for all terrorist detainees.

Nothing is more important than protecting the American people. That’s why earlier this year, House Republicans introduced H.R. 2294, the Keep Terrorists Out of America Act, which would stop the transfer or release of terrorists held at the Guantanamo Bay prison into the United States. The legislation unequivocally opposes releasing terrorists from the Guantanamo Bay facility and transferring them to the United States, makes clear that governors and state legislatures must pre-approve the transfer or release of any terrorist detainee into their respective states, and requires the Administration to meet strict criteria and certification standards before terrorists housed at the Guantanamo prison could be brought to the United States.

With the Administration’s irresponsible actions today, the Keep Terrorists Out of America Act is more necessary than ever.

First off these guys are going to pay a huge price for this pitiful miscalculation.

Americans are the most productive people anywhere and that is because we are the ultimate multi-taskers.

They are just adding to the pile of stuff we are concerned about or angry over. This is just one more log on the fire and we are the ones who have to manage it with our own pokers.

They are very, very mistaken about our ability to wage opposition on a multitude of issues and we will oppose them at every turn.

The funny part, is these war criminals could very well be acquitted.

Why? How?

First off, bringing them to New York? That is beyond laughable. No way could they get a fair trial so their defense attorneys will argue change of venue. It will be granted but where will it ultimately be tried?

Second, Miranda Rights. Not having received them, much of the evidence against them will be quashed or suppressed. Any that is brought forth will be challenged for chain of command or better yet defense will motion for discovery and los and behold they will have to conjure up a battle ship by the name of USS New York. Said ship is constructed of material from the World Trade Center girders but, unfortunately it has been altered.

Where are the remains of the planes?

How did the Hijackers gain control and what weapons where used?

What about 911 truther theories?

Guantanamo and Habeas Corpus, which will likely come up twice. It will most certainly come up when the Defense demands dismissal for failure to bring forth a timely trial and as such again chain of command over all aspects of the case will come up. Funny, when the government starts pulling change of holding status it will become a huge defect in their case.

Why weren’t these alleged murderers (Okay, we still call them terrorist) all availed a competent attorney, who cold pursue a logical, lawful and legal case that follows a traditional path and in some way makes sense?

Torture of a suspect to coerce a confession is not cool. Now if they in jeopardy under the military code of justice as battlefield prisoners then big deal.

But, and really big BUT, when this happens in the traditional area of law enforcement, we let guys go who are indeed really bad guys and we hand them a check. In this case it could indeed be a rather large check.

What about pursuing civil rights violations? Being held against your will in another country? Whoa, man, that is pretty heavy. Being forced to take medication against one’s will, what if they died or were scared silly?

What about the schlubs that got let go? The defense will want to question them but, alas they will not be available for examination. Why is that important? They were rounded up like cattle with the other “alleged” terrorists, now criminals and they may have information relevant to exoneration of these alleged murders.

Well, well, well...now what will become of the suspects upon acquittal? Where will we release them? What if they claim to be stateless? Who will take them?

Couldn’t they apply for asylum? Couldn’t they make a “Federal Case” out of hardship and begin the process of citizenship or alien residency?

What about their ability to go on the college circuit giving speeches?

They are, after all, men who have been held for years for a crime of which they were acquitted.

Shouldn’t they be free to move about the country while they pursue a counter suit and damages for being kidnapped and held as political prisoners for years?

Can’t they sue for damages and their lost lives of the last 8 years?

This is going to be fun, for the alleged murderers and they are going to bask in the Arab and m uslim adoration world wide, while making a fool of our government and justice system.

We, the American Public, are going to be rightfully angry when we let these animals go. But that is the way is the cookie crumbles.

Enjoy the next 5-7 years while the government does their dog and pony show.

Me, I think I will begin eating popcorn without butter.

Notice Obama leaves town when this bombshell gets dropped. For an Attorney general about to go under the bus:

The Wheels on the Bus go Round and Round

Yup, and then we will send emails, letters, and yell our anger. Oh, don't forget the millions we will give them for suffering. King Obama might even appoint them to oversee his soon to be organized private army.

Where will they be kept prior to the trial?

Will they be given/denied privileges available/not available to other Federal prisoners such as special foods, religious facilities or conjugal visitations by goats?

How can a judge treat them equally as other federal prisoners.

Will they be tried separately or together?

So many questions; but I sure that these geniuses thought this through thoroughly. /sarc

I would say they are screwed and will ultimately prevail in a case for damages. /s

The best part of your reply is:

“Will they be tried separately or together?”

They will be tried together. This will ensure they are acquitted. A jury will need to convict all beyond a reasonable doubt.
