Even better! He knew he was wrong..that’s why he was walking away. It makes you wonder how many other people just took his word for it that they had no ‘rights’ and walked away without protesting? This is their strategy..to intimidate and bully people into silence.

First, we don’t know for sure he would have been arrested. Most of what these bullies do is try to intimidate. I’m reminded of Quannel X leading some open-carrying black panthers into Joe Horn’s neighborhood (the Texan who exercised the castle doctrine and shot the two black thugs robbing his neighbor’s house) to intimidate the people there, all of whom supported Horn. Quannel and his boys turned tail and ran when they were drowned out by motorcycle and truck engines being gunned, people surrounding them with menacing shouting, etc..
It’s been my experience that pushing back against these people usually backs them down, especially when they are acting alone. They’re cowards and bullies, and they think white people are afraid of them. I’m not.

You’d have to look at the state codes to find out what all positions constitute peace officer status with powers of arrest. My guess is no. If it’s a misdemeanor or infraction to carry a sign in these circumstances or a certain kind of sign, it has to be committed in front of a peace officer or else done through citizen’s arrest. The department would have stringent rules for that situation, and the sign would not rise to that level. An arrest in this situation would have been a slam-dunk big payday lawsuit and done a lot to quell similar behavior in that neck of the woods for a long time, plus gotten Cheeks the boot. I would have liked to have had the opportunity to file.
What does he say/do to try to goad you?
How often has this happened? Have you ever tried to record him? Several such episodes on tape would make a nice lawsuit that would put an end to his LE career real quick and give you a nice little nest egg.
The only way to stop these people is to make it too costly for their handlers to keep them around.
I’m not a lawyer, but you’re exactly right. Schools are used for a wide range of purposes including religious meetings. School policies applicable to the functioning of the school do not apply to such meetings.
