The Supreme Court only gets involved if someone files a lawsuit. Even if some law is unconstitutional, someone has to file a lawsuit and then see it move up through the courts.
Even if a case has merit, sometimes it is dismissed if a petitional lacks “standing” or can’t demonstrate adverse effects on him personally from a law. So with Medicare for example, somebody would have to file a lawsuit alleging harm from Medicare, and also listing out reasons for it being unconstitutional.
With that, the lost decade (or two, or forever) begins.
