Shredding the Constitution Under the Guise of Economic Stimulus

Several Governors, most notably Gov. Mark Sanford (R-SC) and Gov. Rick Perry (R-TX), have refused stimulus funds, due to the enormous amount of strings attached. Yet due to a provision in the stimulus bill itself, legislatures have the power to override the Governor’s decision, and it appears that at least in South Carolina, that provision may be exercised. In yesterday’s Chicago Tribune, however, Chapman University school of Law professor Ronald Chapman argued that the provision is blatantly unconstitutional and would likely not survive a court challenge, because it may attempt to alter existing state law and state constitutions.

Congress may impose restrictions on receiving of federal funds, but they may not change the state-created processes and procedures for accepting those funds, making laws, or any other such thing. For example, Congress could not pass a law stating that any veto issued by a Governor could be overridden by a simple majority vote of the legislature, or that the Governors of all states have the right to ignore enforcement of legislation they don’t agree with. States have Constitutions and Laws, and the principle of federalism does not allow the Federal Government to interfere with those laws except in Constitutionally-permitted ways.

Never waste a good crises. This is a great way to eliminate states rights. The democrats could dictate social laws forever. Homosexual “marriage” for everyone! Late term abortion for every live infant! Increased state taxes for all!

Obama is about fundamental change. He is not stpid, he is not bungling. H eknows exactly what he is doing and this article has it right.

Obama is a abject marxist ideolog and he is going about a marxist's agenda. That is the fundamental change he is bringing.

They created the crisis, and now they are solving it. It's the old "Order out of chaos" thing where they bring on the chaos (financial crisis)...and make no mistake, Obama himself and these leftist politicians have been egging on the problem for many years...and then propose constitution shredding policies to "fix" the crisis they created.

IMHO, Obama, his administration, and this leftist controlled house and senate are the gravest threats to American liberty in the history of this Republic.

we must educate others and work our hearts out to begin reversing it in 2010 so as to limit the daamage and exposure, and then turn it completely around in 2012.

In the mean time, our Senators, if they will have the gumption, can slow things down with the filibuster as we make enough noise in the weeds to maybe even influence some of the moderate democrats.

The “Obama Youth” bill has similar, absurd provisions in it. It essentially allows individual schools to overrule their districts, cities, counties and states to partake in the various “corps.” that the bill sets up.

It is a provocation. The libtard congress critters can not STAND that there are RED STATES that don’t like them and don’t want Obamunism.

What is happening is nothing more than a coup, quietly and with the help of the media. A media so afraid of losing access that 99 percent won't speak out even as they see what's happening.

Congress, is simply contemptable, those who are not marxist are guilty of a even bigger sin........... Laziness, they pass bills they don't read, they pass bills they know are wrong because of fear of political correctness.

Whats missing are Patriots, the question is,will they show up?

I think they will, I believe the public has been pushed too far and they will snap back.

Thanks for the ping bamahead.

Jeff, MOST of your points are excellent and dead on IMO. BUT....

You no doubt recall the "conservative" revolution of '94 when Pubbies won both houses of congress. They began implementing "change" we could in fact believe in. In fact the only item in the Contract With America that failed to pass was, you guessed it, term limits. Oh well, we can't have it all right.

The elections of 2000 puts a Pubbie in the White House and made it a clean sweep of DC. The adults were back in charge, or were they? Actually, things went fairly well for a time, then THEY TOO caught Potomac Fever and began overstepping their Constitutional chains. After the dust settled the only difference I could discern between our guys and the Dims was WHO the beneficiaries were of taxpayer generosity.

My FRiend, we need to implement some fundamental change of our own; not so much change, but a return to the fundamental principles of our Constitution. Hence, my support for State initiatives putting the feral government on notice under the auspices of primarily, the 10th Amendment. Even this is only a start though and given the culture and momentum of marxist idealogies, won't soon turn the beast into the servant of the States and The People it once was.

There needs to be a starting point and the 10th Amendment movement is about as good as any. In fact, I believe it may be our last hope of recovering our Republic. Your mileage may vary...

I agree. The GOP candidates, far too many of them, abandonded their principles and their base and got caught up in the guise of so-called "compassionate conservatism" which was used as an avenue to the same old spend, spend, spend tactics fo the leftists. Different programs perhaps, with what they hoped would be different results.

But mainly, it was about trying to buy constituents and loyalty with their so-called "compassionate conservatism", and besides being just flat a$$ed wrong, it could not hold a candle to the letftists for give away purchase of votes. The people inclined to be "bought" always go to the highest bidder.

So, those turn-coat and misguided GOPers got their back sided handed to them on a platter by the very people they were seeking to purchase...and by their own base who were disgusted at the attempt.

That HAS to change, and we have to have political candidates who will be patriots ands statesmen or there will be nothing to win the country back for.
