Great Gun Grab of '09: House Bill HR 45

Should government require individual citizens to possess a license to practice free speech or religion (1st Amendment)? How about requiring a license that grants you freedom from cruel and unusual punishment (8th Amendment)? These are ridiculous, unconstitutional proposals; but when has that ever stopped a lawmaker, especially a liberal Democrat?

Representative Bobby Rush, Democrat of Chicago and a constitutionally ignorant man, proposes to license (infringe) the constitutional right of the people to keep and bear arms (2nd Amendment). He wants to outlaw possession of firearms by anyone not possessing a federal firearms license. I can think of no other constitutional right that is treated in this manner.

HR 45 1/6/2009--Introduced. Blair Holt's Firearm Licensing and Record of Sale Act of 2009 - Amends the Brady Handgun Violence Prevention Act to prohibit a person from possessing a firearm unless that person has been issued a firearm license under this Act or a state system certified under this Act and such license has not been invalidated or revoked. Prescribes license application, issuance, and renewal requirements.

The licensing requirements this former Black Panther insists upon are burdensome. The section about safe storage as pertaining to children (those under 18 years old) makes it legally impossible to keep loaded weapons or to even separately store weapons and ammo in such a manner as you could quickly use them in defense of your home.

This bill infringes upon a constitutional right which comes from God. It criminalizes the previously legal act of owning a gun. I have a right to possess firearms, and can only lose that right through illegal activity. This proposed legislation turns a citizen into a supplicant, begging a bureaucrat for the privilege to own a gun. It makes it harder to legally defend your home and property, and will impede illegal weapons trafficking not at all.

Is this the Democratic agenda for America? Write your elected officials and tell them they can keep it, and suggest they read the US Constitution while they're at it.

These people are treading on some very dangerous ground. Most conservatives I know are ex military, including myself.

I thought Scalia just drove a stake through this idiocy.
Apparently not. We only hold the Constitution valuable on subjects we want it to.
Until the composition of the court changes, though, I don't see this getting done.

Imagine for just a second the United Nations passed a worldwide resolution proclaiming that people worldwide could not punch back if they were punched in the nose. An action should be met with a proportional consequence, but the United Nations wants to stop this and have everyone put their hands up. That would be crazy, not to mention immoral and unethical. People the world over would say they are not complying with such a resolution, and justifiably so as self-defense is a basic human right. But that is precisely what is happening when guns are not allowed in the hands of law-abiding citizens!

The SCOTUS cannot force the government to carry out their rulings. The SCOTUS has no guns.

Wasn’t this already determined by the SC heller decision? Owning a gun is an enumerated right.

Bingeaux, though Daley (aka BHO’s boss) pitched a royal hillary about it.

Any attempt to gut Heller without a constitutional amendment will fall either to a Court decision or the Bowman option.

Liberals believe that they will be able to license and eventually confiscate firearms with little or no resistance from the public. And why should they believe any different? History has shown that free people have meekly given up their right to arms and turned them in without so much as a foul word.

I would be satisfied if there was some agency tasked with making sure all candidates at the federal level met the minimum constitutional requirements.

It is pretty clear where this administration does stand when they put this on the official WH website.

The Second Amendment gives citizens the right to bear arms.
