Most likely, however the case goes, it’ll be a nailbiting 5-4 decision. The tiebreaker, of course, will be Anthony Kennedy and whether he’s having a bad-hair day.

I believe it only requires four justices to bring the case up for argument.

It takes 4 positive “votes” in conference for the SCOTUS to bring the case to trial.

I don’t see Roberts agreeing to it. Conference vote: 6-3, “nay”.

Other than maybe Ginsberg (who was an idiot before she became a senile idiot), I really don't imagine that SC justices would agree that it isn't really important for a president to be constitutionally qualified for office.

I think they are going to want Obama to prove he is a natural born citizen.

Maybe he can and this is all just a dopey excercise. Or maybe he can't and then it gets interesting.

What’s going to be interesting is if the USSC justices rule that the case does not have legs... and if at some point in the future it becomes known that Obama was not eligible, after all, to become President.

At that point I believe there would be an awful lot of angry, pissed off people (about half the country)...and they’ll be just as pissed off at the justices that ruled Obama into office ANYway as they are at Obama himself.
