Bush executive order threatens 5th Amendment?

On Tuesday, July 17, President Bush issued an executive order that could be interpreted to outlaw anti-war protest.

This new executive order empowering the federal government to freeze the assets of people who threaten Iraq's stability and its government is so broad it could be applied to any domestic opponent of the Iraq war who has assets in the U.S., charges a former Reagan administration official.

White House press secretary Tony Snow explained the order targets terrorist and insurgent groups not covered by existing authorities who come across the border from countries such as Iran and Syria.

But constitutional lawyer Bruce Fein charged the order violates the Fifth Amendment's requirement that no person shall be deprived of property without due process of law. Fein, associate deputy attorney general under Reagan, asserts it "empowers the president to destroy anyone he says plays a significant risk of undermining the rehabilitation or political reform in Iraq."

"The is a stunning assertion of executive power that creates a Sword of Damocles over anyone opposed to the war or otherwise who might come under the umbrage of the president," Fein told me.

Last year, Fein testified in favor of a Senate resolution to censure Bush for authorizing the National Security Agency to monitor without a warrant some U.S.-based calls with suspected links to terrorists.

Bush's new order authorizes government agencies to freeze the property of anyone who has committed or might plan acts of violence in Iraq. It also targets anyone seeking to disrupt reconstruction efforts or harm humanitarian workers in the country.

Freezing the funds potentially going to finance terror is a good thing.

Seems some process will determine later what happens to the frozen funds so that should be the due process everyone on some level would expect.

PS, terrorist love to use our laws and freedoms agaisnt us. I do understand the need to fight back with changes in times of war like this.

For many years assets have been seized which are “suspected” of being profits from illegal drug operations with no charges, arrests, or other legal action.

Congress may overturn an executive order by passing legislation in conflict with it or by refusing to approve funding to enforce it. In the former, the president retains the power to veto such a decision; however, the Congress may override a veto with a two-thirds majority to end an executive order..

if this is true, let Congress have at it.

Bush needs to get a declaration of war so he can use his full Presidential powers. Failing that, he should withdraw our troops from Iraq, and publicly state that he is doing so under overwhelming pressure from the Senate. He should state that he is relenting to the Senate against his own better judgement. He should leave two divisions and some air power in the northern Kurdish area of Iraq to maintain a military foothold in the region, and to have a 'stablizing presence' there. Then send the remainder of the troops into Afghanistan and over the Pakistani border where the al Quaida and Taliban leadership are.

This would crush the head of the al Quaida snake, and it would allow the civil war in Iraq to rage on until hundreds of thousands of islamofacists are enjoying their virgins. Then Bush can say, "I told you so, we never should have left Iraq", to the Democrats, and the blame for the fiasco will fall on the Dems. THEN, while still having a year or so left in Office, Bush can move our troops back into Iraq to "quell the bloodshed and stabalize the region". This time though, the military invasion should be initiated under a vastly different military perspective. The new rules of engagement should be a no-holds-barred war against the swarm of al Quaida and other islamofacists who will have swept into the vacuum to gain control of much of Iraq. Leaving Iraq with the intent of coming back to a greater number of enemy to kill would, imho, be a stroke of genius.
