Following is a transcript of Mayor Giulianis address today to the SC GOPs executive committee in Columbia, South Carolina, with regard to the mayors judicial philosophy:
On the Federal judiciary I would want judges who are strict constructionists because I am. Im a lawyer. Ive argued cases in the Supreme Court. Ive argued cases in the Court of Appeals in different parts of the country. I have a very, very strong view that for this country to work, for our freedoms to be protected, judges have to interpret not invent the Constitution. Otherwise you end up, when judges invent the constitution, with your liberties being hurt. Because legislatures get to make those decisions and the legislature in South Carolina might make that decision one way and the legislature in California a different one. And thats part of our freedom and when thats taken away from you thats terrible. President Bush has the great model because I think as the President he did appointed (sic) some really good ones and both of them are former colleagues of mine - Chief Justice Roberts and Justice Alito. I think Chief Justice Roberts is a great chief justice and hes young and he can have a long career and thats probably the reason the President and Vice President chose him. I think those are the kinds of justices I would appoint Scalia, Alito and Roberts. If you can find anybody as good as that, you are very, very fortunate.

Honestly, I don't believe that Rudy is really a strict constuctionist. I'm not naive. But I *do* believe that he will appoint judges like Robert and Alito and that they will exercise the actual power regarding the interpretation of the constitution. Why do I believe that? Because Rudy is a team player- he realizes he needs the support of Republicans to win the election and he will need the support of his party members in Congress if he gets elected. So he will reach out to satisfy his party on the issue of judicial appointments without expressly renouncing his views.
I take it then that you thing that some of the current topics that are trying to make there way to the Supreme Court, like "gay" marriage, are NOT "social" issues (culture, socially derived mores)?
He supports Roe. He opposed the Second Amendment. But he's a "strict constructionist" -- he says, whatever that means.
If Rudy Giuliani is a strict constructionist, then John Kerry is a fiscal conservative.

So, Rudy has actually advocated the repeal of the Second Amendmend?! That's huge news! Why hasn't anyone else heard of this?

I look at a politician's long-time track record, and RINO-rudy's is UNDOUBTEDLY RABIDLY ANT-GUN/ANTI-2A.
I vote by using my BRAIN, not my emotions, and my brain tells me to forget what rudy, or any other RINO now says, RIGHT BEFORE running for the highest office in the land.
With these sort of political scumbags (liberal dems and liberal RINOs), it's all about political expediency, and they are NOT going to fool most TRUE conservatives.
WRONG.. Rudy doesn't feel the 2nd amendment is UNalienable..

He could say "I'll appoint strict constuctionists" and I MIGHT buy it.
But nobody who support abortion or gun control is a "strict constructionist."
Wow. Scalia, Roberts, Alito, Thomas are all fantastic judges. If Rudy means those are the type of judges he will appoint at all levels of the judiciary, I'm on board. There is pretty much no more federal legislation that is going to do any good without the SCOTUS allowing it. Sending these social issues back to the states is where they belong anyhow.

That kind of comment is so hyperbolic it lacks any credibility.
No, Rudy hasn't supported the repeal of the 2nd Amendment because Rudy isn't a real strict constructionist.
A strict constructionist doesn't necessarily agree with everything in the Constitution (and Rudy clearly hates guns), but if he disagrees with a portion, he supports the introduction an amendment to change it.
Judicial activists on the other hand just ignore or reinterpret the constitution to suit their political beliefs. That's what Rudy did, as District Attorney and as mayor -- he simply ignored the 2nd Amendment as he went after guns.

Rudy is way too liberal as McCain is mercurial (and liberal) but I will hold my nose and vote for either one of them before ANY democrat. National Security trumps all.
it's particularly important because people here seem not able to differentiate between the views a mayor of a city may hold on many issues, and how those views translate on the federal level. I've said before, Giuliani represented his city and the views of the people in it. I'm happy with strict constructionism regardless of someone's personal views on just about anything.
