Instapundit.com has cited several reports on this case in the past few days.

"Right. We know that one of the three is an infant. It's safe to assume the second person is the infant's mother. So what's your point? Did you expect the infant to be shooting too?"

I think there were a total of four residents at the duplex, including the child.

Post #4 above reads: "Two other residents of the duplex were temporarily detained, but then released without charges, the Associated Press reported."

Two other residents, plus the shooter, plus the child makes it four. I don't think law enforcement would detain and subsequently release a one-year-old child. But I agree with your points above.

I also would expect a 21-year old (the cop killer) not to have a known previous criminal record. Morover, if no drugs were found, it's possible one of the three adults had enough time to dispose of them, especially if they were hidden close to the toilet flush. These criminals ain't stupid, you know.

"The truth will never be known. The cops will protect their own. They will say that they announced that they were cops before entering true or not."

What if they did announced they were cops... it does mean that the sleeping man heard them. It seem like this could be a tragic mistake.

Yes, I meant the system, but the cop also should have known someone is going to start shooting if you break in unannounced. I blame his superiors and all the elitist people that think we should bow down to the police forces and not say boo when they smash down our doors without warning.

It is a shame that this disregard for the law of the land has resulted in two lives ruined, one gone, and one about to go.

I agree there isn't enough evidence to go on in this article but I do believe that the guy thought he was being broken in on by criminals, due to his not having a criminal record and by the fact he quit firing after 3 shots and slid his gun away. He had no reason to shoot at cops, no drugs or other illegal contraband in the house, why would he shoot it out with the cops especially with his baby lying there in danger?

Nothing will come of this. The government likes having the power to issue no-knock warrants. The government runs the judicial system. This case will probably remain buried. If not, Mr. Maye may suffer an unfortunate accident in prison. The government will not allow their power to violate the 4th Amendment to be put at further risk. We have already lost the war folks. We just haven't admitted it yet.

"But there was NONE and nothing else so a break in occurred and the people breaking in got their just rewards and an innocent is being killed because of it."

Just because the cops didn't find the drugs doesn't mean there weren't any. Amongst the three young man, one of them could have had enough time to dispose of the drugs during the shootout. Yong criminals aren't stupid to be caught with the drugs. They know an unexpected visit could happen at any time and they must be prepared to dispose of their drugs in seconds. I believe this is what happened in this case.

Also, the innocent man you talk about is not about to be killed - he's already dead. Unless, you don't consider the life of a young police officer an innocent life.

One of the articles posted on this thread talked about how the cops first tried to go in the front, indentified themselves, and then tried to go in the back.

I'd be interested to know whey they couldn't get in the front, first of all.

Secondly, if that's true, it seems pretty far-fetched for cops to make up a detail like that, one they'd all have to agree on and provide corroboration for. No matter how tight the police 'cronyism', if that is the case here, I find it hard to believe that ALL the cops present would go along knowing the end result could be a dead 21 year old man.

And third, if the above is true, I find it hard to believe that the 21 year old didn't know they were cops when they came in the back.

My 2 cents.

Especially considering if I had just shot someone I knew was a cop doing his job, that's the first thing I would say if I wanted to lie my way out of the chair.

When he shot his weapon, he thought he was shooting a burglar or rapist.

Why did the police in this article refuse to say what they were searching for, or even if they had a warrant?

So now you're giving credence to newspaper reports?

As opposed to crackpots with anti-cop pro-drug agendas? You betcha.

The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures

And?

Try reading the first paragraph of the Free Republic home page

I didn't see anything about dope and cop killing.

Answer this: IF a man is asleep in his house...a cops bust in UNANNOUNCED

Jury didn't buy that tale.

And cops have NEVER manipulated facts to fit their scenario

And cop haters NEVER spew unsupported charges against police.

Why would a man with no criminal record, not pay attention to cops screaming out they are police and decide to shoot one?

Perhaps he shared the lunatic obsessions of several posters on this thread.

Which brings the question why did Maye not demand a speedy trial?

I don't know that he did or he didn't.
