according to Marty Lederman, anyway.
LOL, yeah, yeah, suuuuuuuure you are.
Dunno.
Ask him.

I think Rehnquist is gone today, and I think it's great. Can you imagine how bonkers they'll be going when we get two originalists in parallel hearings?
I hate to break it to Marty, but I think his source just burned him.
"Parents, it's 5:00 P.M. Eastern Time. Do YOU know where YOUR Chief Justice is?"
If'n we could just get one more to announce so the President would have a trifecta then both extremes of the political specter could go bonkers.... Malken has Drudge reporting who's source is anyones guess, maybe Novak who's source we have no idea..... Great rumor mongering.... don'tcha just love it....
I saw some article that now has four hispanics in the mix, three from Texas and Estrada..... LOL.
Down in the (DU)mps:

Bush gets 3 if he promotes Scalia to CJ.
I've been predicting Luttig for Chief Justice and McConnell for Associate Justice. But Bush is not the type of person to just appoint 2 white guys when a woman is retiring. So, I guess it will be Luttig for Chief and either a woman or a Hispanic for Associate.
ROFLOL!!! This circus is getting fun to watch -- stand back and watch both extremes go nuts!
This is going to be fun to watch! I cannot wait for the hearings and see Dr. Tom in action!
I think he got burned too -- it is even better this way because the Libs are going bonkers not knowing if it is true and then being hit with a Stevens retirement -- been sitting here laughing!
Dr. Coburn is saying William Pryor would be great, and I am thinking he will replace a woman with a woman -- Janice Brown would be perfect. That would be two they just confirmed off that list which would be hilarious to watch.
It is now 5:50 EDT and no retirement.
Drudge changed his headine briefly to say there would be an announcement tonight, but is now backing off and it just says "Report: Rehnquist to retire."
Looks like SCOTUS blog may be correct.
However, then again, Red State says this as an update:
"Update [2005-7-8 17:20:42 by Erick]: William Rehnquist, Chief Justice of the United States, has retired. A White House statement is forthcoming. Should caveat this: A very good source says this."
Red State has updated and said the retirement has occurred......this is not confirmed by Drudge (who seems to be backing off the story) or any other place:
Red state update: "Update [2005-7-8 17:20:42 by Erick]: William Rehnquist, Chief Justice of the United States, has retired. A White House statement is forthcoming. Should caveat this: A very good source says this."
He also said 2 other sources told him that, though no WH sources.
I have a feeling people across the nation will get to know him for the first time. I can't imagine he'll be tranquil.
You can be sure of that -- tranquil and Dr. Tom or Senator Inhofe for that matter, do not fit well in the same sentence!
I think that source is right that he will be retiring and wouldn't surprise me that the President gets his letter upon return to the White House. That said, I am going out to finish mowing my lawn which means the announcement will occur momentarily since I delayed mowing to hear! :)
How so?
Because he gets ONE new justice for O'Conner, TWO Scalia gets promoted to CJ instead of Rehnquist, THREE he gets to appoint another new justice to take Scalia's old spot. One, two, three solid conservatives, plus Thomas.
Now, if Stevens, Ginsburg, Kennedy, or Souter retires (or dies) he gets FOUR, FIVE, SIX & SEVEN. Wouldn't that be sweet? Breyer would have to write all the dissentions.
