The following are Terri Schiavo's sister, Suzanne Vitadamo's and Attorney Barbara Weller's sworn testimony submitted to Judge Greer in Pinellas County Court today.

Barbara Weller, Esq., is putting her entire professional reputation as an officer of the court on the line. If she is not telling the truth she would not only be found guilty of perjury, she would sacrifice her career by being disbarred.

DECLARATION OF SUZANNE VITADAMO STATE OF FLORIDA ) COUNTY OF PINELLAS )

I, SUZANNE VITADAMO, sister of the Petitioner in the above-styled case, hereby declare under penalty of perjury:

1. I visited with Terri at various times during the day on March 18, 2005, the day her feeding tube was removed.

2. Terri was in good spirits that morning. My husband, Michael Vitadamo and Terri's aunt, Claudia Tamarro, were in the room with myself and Attorney Barbara Weller when Terri attempted to speak to Mrs. Weller. A female Pinellas Park police office were standing at the door of Terri's room.

3. Terri was sitting up in her lounge chair and Mrs. Weller and I were sitting on her bed. My aunt was standing at the found of Terri's chair.

4. Mrs. Weller stood up and learned over Terri. She took her arms in her hands. Mrs. Weller begged Terri to try to say, "I want to live." Terri's eyes opened wide, she looked at Mrs. Weller with great concentration and said, "Ahhhhhhh." Then, with great effort, she screamed, "Waaaaaaaa" so loudly that Michael Vitadamo and the female police officer who were then standing together outside Terri's door, clearly heard her. Terri had a look of anguish on her face and she seemed to be struggling hard, but was she could not complete the sentence. Terri began to cry and Mrs. Weller and I began to stroke Terri's face and hair to comfort her.

5. Mrs. Weller and I continued to visit and talk with Terri, along with other family members who came and went in the room.

DECLARATION OF BARBARA J. WELLER STATE OF FLORIDA ) COUNTY OF PINELLAS )

I, BARBARA WELLER, Attorney for Respondents in the above-styled case, hereby declare under penalty of perjury:

1. I visited with Terri at various times during the day on March 18, 2005, the day her feeding tube was removed.

2. During the morning I was in the room with Terri and various members of her family. Terri was in good spirits that morning. The mood in her room was jovial, particularly around noontime, as we knew Congressional attorneys were on the scene and many were working hard to save Terri's life. For most of that time, I was visiting and talking with Terri along with Terri's sister Suzanne Vitadamo, Suzanne's husband, and Terri's aunt, who was visiting from New York to help provide support for the family. A female Pinellas Park police office was stationed at the door outside Terri's room.

3. Terri was sitting up in her lounge chair, dressed and looking alert and well. Her feeding tube had been plugged in around 11 a.m. and we all felt good that she was still being fed. Suzanne and I were talking, joking, and laughing with Terri, telling her she was going to go to Washington D.C. to testify before Congress, which meant that finally Terri's husband Michael would be required to fix her wheelchair. After that Suzanne could take Terri to the mall shopping and could wheel her outdoors every day to feel the wind and sunshine on her face, something she has not been able to do for more than five years.

4. At one point, I noticed Terri's window blinds were pulled down. I went to the window to raise them so Terri could look at the beautiful garden outside her window and see the sun after several days of rain. As sunlight came into the room, Terri's eyes widened and she was obviously very pleased.

5. Suzanne and I continued to talk and joke with Terri for probably an hour or more. At one point Suzanne called Terri the bionic woman and I heard Terri laugh out loud heartily. She laughed so hard that for the first time I noticed the dimples in her cheeks.

6. The most dramatic event of this visit happened at one point when I was sitting on Terri's bed next to Suzanne. Terri was sitting in her lounge chair and her aunt was standing at the foot of the chair. I stood up and learned over Terri. I took her arms in both of my hands. I said to her, "Terri if you could only say ‘I want to live' this whole thing could be over today." I begged her to try very hard to say, "I want to live." To my enormous shock and surprise, Terri's eyes opened wide, she looked me square in the face, and with a look of great concentration, she said, "Ahhhhhhh." Then, seeming to summon up all the strength she had, she virtually screamed, "Waaaaaaaa." She yelled so loudly that Michael Vitadamo, Suzanne's husband, and the female police officer who were then standing together outside Terri's door, clearly heard her. At that point, Terri had a look of anguish on her face that I had never seen before and she seemed to be struggling hard, but was unable to complete the sentence. She became very frustrated and began to cry. I was horrified that I was obviously causing Terri so much anguish. Suzanne and I began to stroke Terri's face and hair to comfort her. I told Terri I was very sorry. It had not been my intention to upset her so much. Suzanne and I assured Terri that her efforts were much appreciated and that she did not need to try to say anything more. I promised Terri I would tell the world that she had tried to say, "I want to live."

7. Suzanne and I continued to visit and talk with Terri, along with other family members who came and went in the room, until about 2:00 p.m. when we were all told to leave after Judge Greer denied yet another motion for stay and ordered the removal of the feeding tube to proceed. As we left the room, the female police officer outside the door was valiantly attempting to keep from crying.

8. About four in the afternoon, several hours after the feeding tube was removed, I returned to Terri's room. By that time she was alone except for a male police officer now standing inside the door. When I entered the room and began to speak to her, Terri started to cry and tried to speak to me immediately. It was one of the most helpless feelings I have ever had. Terri was looking very melancholy at that point and I had the sense she was very upset that we had told her things were going to get better, but instead, they were obviously getting worse. I had previously had the same feeling when my own daughter was a baby who was hospitalized and was crying and looking to me to rescue her from her hospital crib, something I could not do. While I was in the room with Terri for the next half hour or so, several other friends came to visit and I did a few press interviews sitting right next to Terri. I again raised her window shade, which had again been pulled down, so Terri could at least see the garden and the sunshine from her lounge chair. I also turned the radio on in her room before I left so that when she was alone, she would at least have some music for comfort.

9. Just before I left the room, I leaned over Terri and spoke right into her ear. I told her I was very sorry I had not been able to stop the feeding tube from being taken out and I was very sorry I had to leave her alone. But I reminded her that Jesus would stay right by her side even when no one else was there with her. When I mentioned Jesus' Name, Terri again laughed out loud. She became very agitated and began loudly trying to speak to me again. As Terri continued to laugh and try to speak, I quietly prayed in her ear, kissed her, placed her in Jesus' care, and left the room.

A case for Criminal Investigation of Michael Schiavo:
1) Nurses' testimony: Heidi Law, Carla Sauer-Iyer, Carolyn Johnson have been ignored and dismissed without hearing; each testified that Michael was abusive to Terri and may have attempted to kill her by insulin injection and attempts to induce pneumonia by turning the thermostat in her room to 64 degrees.

2) Michael Baden, top forensic pathologist in country and interviewed on Fox News National Television broadcast October 25, 2003 on Terri's bone scan and injuries states that:
a) Terri's injuries are not consistent with a heart attack; no cardiac evidence to support it
b) Extremely rare for potassium imbalance on woman her age and in her good health
c) Injuries are consistent with severe trauma possibly caused by a beating
d) The injuries in medical records warrant an immediate investigation

3) Dr. William Hammesfahr, Nobel prize nominee and neurologist testified that Terri's neck injuries are consistent with only one type of injury: that of strangulation.

4) Terri's doctor, Dr. Gambone resigned; he had previously testified Terri would die within a few days of starvation/dehydration. Terri has an obvious will to live.

5) Michael has enlisted the services of a new doctor, Stanton Tripodis, who has 5 malpractice suits against him. Clearly, Michael is attempting to provide sub-standard care for his wife.

6) Michael is committing adultery by living with another woman who has already born one child with another on the way, thereby creating an obvious conflict of interest as guardian.

7) Michael has committed both perjury (2 counts) and insurance fraud by promising to provide care and therapy for his wife in exchange for the court award of 1.2 million dollars in 1993. No care has ever been provided to Terri.

8) Michael Schiavo has also prevented Terri from undergoing a barium swallow test, a procedure necessary to ascertain the consistency of foods able to be taken by mouth.

9) Co-conspirator George J. Felos combined and conspired with Michael Schiavo to arrange for Terri's "free" stay at Hospice Woodside as part of an "exit protocol" designed to advance Felos' self-perceived messianic mission of "helping" incapacitated people to die by categorizing them as "terminal," warehousing them, and depriving them of therapy and rehabilitation services. (Attorney Felos is Director of Florida Right to Die and has testified that he can ascertain a person's desire to die by "looking into their eyes and letting their spirit speak directly to him")

10) Investigate Insurance company established in Jan 2001 at the home of Michael Schiavo and his girlfriend/fiancee Jody Centonze. (Jerger and Centonze Insurnace Agency Inc.) Michael is listed on the Board of Directors for the corporation. Note: Insurance is deliberately misspelled in the State of Florida Corporate filing, possibly to avoid investigation.

'Judge' (Ghoul) Greer is a heartless, vicious 'bench' butcher, and what alarms me even more, he is not alone in the courts in this case of the inauguration of America's 'out in the open' culture of mandated death.. This is how the horrors of Nazi Germany began...nice & 'legal'.

The thug husband's lawyer, George Felos contributed to 'Judge' Greer's election campaign, plus Mr. Lawyer is also promotes of the 'right to die' (for other people) like 'test case' Terri.

Sorry, I had it backwards. The newspaper report said "I wan". But that really isn't the point.

The point is that claims of newly discovered evidence are important to try to reopen a case after the trial is over, particularly when you have a situation where congress has called for a de novo review, which should include new evidence.

Why didn't the lawyers include this in their moving papers before the courts earlier this week when it happened a week ago, before Congress even passed the law giving the federal courts jurisdiction? Are they totally inept?

God bless you Barbara Weller. You have more dignity and goodness in your little toe vs. slime vermin ghoul judges like Greer et al. We need more...many more attorneys cut from the same cloth as you. The forces of darkness will not prevail. Just the mention of 'Jesus name' in your affidavit will twist their little perverted spines. How dare they do this to one of God's innocent children.

I didn't know about Michael being a part of the insurance company or the misspelling until now. Recognizing how good Mikey is at convincing people that he is such a wonderful honest person, do you think he sweet talked his fiance into this so he has a little leverage with her to keep her from testifying against him. After all she is still just his fiance and therefore can't legally refuse to testify against her husband. This sounds just like something my ex would have tried to do. (My ex was also abusive toward me and other women.)

We cannot rely on the court to reconsider it's ruling when you have a judge who is morally bankrupt. This case is not about the law. It's about agenda on the part of judges such as Greer and lawyers like Felos(I am assuming that most of my fellow FReepers are aware of facts/information surrounding this case).

I am not suggesting that Terri has no hope. I will continue to pray that Gov. Bush will do what is right and take her into protective custody, regardless of the threats made by judge Greer.

Sadly, HINO and Greer have maintained a death grip hold (pardon the black humor pun) on Terri. Her parents have filed just about every motion they can think of to gain some semblance of access to her and a loosening of HINO's/Greer's legal control. That includes a petition to Greer on Terri's behalf to divorce HINO. Promptly dismissed. HINO is her legal guardian (appointed by Greer), makes all decisions for her and unless he consents to a divorce, will never happen. She dies first -- and only then will the marriage be dissolved.
HINO cannot afford and does not wish to lose his control of Terri. His control over her is at what seems to be to fanatical level.
And, Greer long ago ordered that absolutely no videotaping or photographs are permitted, or they will be in contempt of court. Since the family members must go through a gauntlet of several pat down searches before being allowed into Terri's room, there's absolutely no chance that any camera or other device would escape notice.

After my last post regarding the insurance company, I got to thinking about the reports that Mikey took out an insurance policy on Terri. Does anyone know when he took out the policy, how much the policy is for, and what ramifications there might be regarding payment on the policy since Terri is being starved and dehydrated to death at the behest of her spouse and as ordered by judge Greer. Just wondering if a beneficiary can collect when they are the ones who requested the death through the use of withdrawal of food and water...Or is this why Mikey relinquished his guardianship rights to the judge on this matter.

He controlled her every move before "incident" - so you are right, it continues. Plus, if she got therapy and talked - well, possibly a different home for MS, the judge, freek Felos, Hospice Center (under FF's control) and others when the can of beans is fully opened.

CREMATION......getting rid of the evidence. The Florida mafia - the men in black - rule.

About 2 mos ago, I e-mailed the parents (from Terri's website) to see if they could get an emergency annulment from the Vatican since the Vatican is well aware of the situation. No doubt in my mind they did it all.

There's quite of background activity being proposed, investigated and pursued to continue peeling back the layers of corruption that require Terri's execution for CYA purposes.

Felos announced today that HINO has consented and approved for the Pinellas County ME to perform an autopsy. I don't believe for a minute that HINO's consent was voluntary as indicated by this announcement. ME decisions to perform autopsies prior to burial or cremation are nearly totally autonomous and beyond judicial review when ordered for cases with suspicious circumstances. I hope the Schindlers will be able to have their own selected independent ME observe and participate in the autopsy.

Good idea, but would not, unfortunately, be a civil dissolution to affect and change the guardianship issue before Greer. It would, however, certainly provide some measure of comfort for Terri's parents that her religious marital relationship to this lying POS were forever severed.
For nearly as long as you I've been suggesting that the Vatican bestow honorary citizenship on Terri and she could then have some measure of international citizenship and diplomatic protection to get her out of that Woodside Hospice hellhole where's she's been imprisoned for so long.

Last week the Iceland Parliament approved honorary citizenship for Bobby Fischer on humanitarian grounds (Washington Post reported in 3 separate articles:

This morning, I called the Iceland Foreign Ministry (from San Francisco), but was told it's closed today since yesterday was Easter.
There are two Iceland consulates in Florida (Talahassee and Ft. Lauderdale) and, of course, the embassy in Washington, D.C. I was told by an Iceland consulate employee here in San Francisco that Terri's parents must be the ones to request honorary Iceland citizenship for her.

Finally, on 3/1805, HINO appeared (again) on Larry King Live. Felos was there at his side. HINO made a crucial testimony slip which goes to the guts of his case about Terri's wishes. There's a Florida attorney commentary here: http://isteve.blogspot.com/2005/03/inside-story-on-schiavo-case.html on that point, which is the only legal basis that could overturn the original judgment, because Greer issued his ruling based on HINO's position of certainty that Terri did not want to be artificially sustained. For this interview, HINO has obviously reversed position. So, was he lying in court, or lying here? HINO lied somewhere. And since Felos was sitting there right by HINO, as an officer of the court, he's required under judicial canons and by his attorney oath to disassociate himself from untruthful situations, and most especially this case which presents a situation constituting fraud on the court. Not having done so, Felos is now a participant in a conspiracy.

At present, these two can rightfully be suspected to be attempted murder conspirators, or if (hopefully not when) Terri dies, murder conspirators.
