The maker of the Segway Human Transporter has agreed to recall the motorized scooters because riders have been injured falling off when its batteries are low. The Consumer Product Safety Commission announced the recall Friday, saying that three people had been injured. One suffered a head wound and needed stitches.

There was never a discussion, just your insults and ignorance.
I'm still waiting for an answer to my original question, which is really why I posted. If you don't want to answer just say so. I've even given you two possible answers to use in order to simplify things.
From my original post:
'So if accidently someone heated coffee up to 300 F and then served it, your answer would be the same?'
Here are my sample answers. Feel free to use one.
(1) 300 F is probably too hot to not expect McDonald's to take some responsibility.
or
(2) 300 F is not too hot to expect a reasonable person to take total responsibility for their actions, including spilling coffee.
If you answer (1), then I would say we are in essential agreement.
If you answer (2), then I would say we are not in essential agreement.
So simple...

Exactly. It's the duty of manufacturers to make their vehicle as capable as possible of not harming the occupant when running out of fuel (something that's bound to happen once in a while). Planes can glide, cars can coast, helicopters are graceless beasts to begin with, Segway should have built something in to start with. They didn't and now they're getting recalled for not asking important questions early in the development process.

As a QA engineer it's actually my JOB to tell people like Kamen when they're head is too far in the clouds and they need to come back to reality. I'm not casting aspersions on him, I'm telling the truth, he's a really smart guy with technology who has no ability to wrap his head around market nitches and market necessities. With Segway he invented a nifty gadget that was over teched and subsequently overpriced and is doomed to market failure. The fact that he never stopped to ask "what happens if the batteries run dry while somebody is driving it" shows I'm right. I never said the guy wasn't above the ordinary, but every man has limits, successful men know their limits and hire people that have strengths in those areas and listen to them closely.
Now why don't you calm down, or does going off on people after grossly misreading their post make you feel better about your little life?
