Dad who pluggedprowler spurns deal

A Navy veteran who shot an intruder in his toddler's bedroom decided against pleading guilty to a gun charge yesterday. Ronald Dixon rejected a deal that would have spared him from having to do jail time because he does not want a criminal record, his new attorney said.

Brooklyn District Attorney Charles Hynes initially charged Dixon, 27, with possessing an illegal weapon - an unregistered pistol - after he shot a career burglar he found prowling in his Canarsie home on Dec. 14.

Last month, Hynes reduced the charges to misdemeanor attempted weapon possession, which carries a maximum 90-day jail term. Hynes said he would only ask Dixon to serve four weekends in jail in exchange for a guilty plea.

Criminal Court Judge Alvin Yearwood changed that deal to a year's probation.

"After the people reduced the charges, this was put on for possible disposition," Yearwood told Dixon and his new attorney, Joseph Mure, yesterday. But the Jamaican immigrant declined the deal and left the courtroom without comment yesterday.

"That means he would have a criminal conviction, and that is a big concern to us," Mure said afterward.

Dixon gained widespread sympathy after he was charged with a crime. In a tearful interview, Dixon told the Daily News he could not afford to spend any time in jail because he was working seven days a week to support his family and pay his mortgage.

I think the poor guy would probably be welcome here in Arkansaw, along with all us other toothless, barefoot, subpar yokels who were stupid enough to get Bill Clinton out of the state by pushing him for president.

I don't think anyone is under any obligation to prosecute illegal laws, so his choices are actually: Do his job and drop the charges, or prosecute an illegal law.

So, he should just use 'His' judgement, and only prosecute laws he agrees with, or against clients he doesn't like. huh? Why go through the bother of challenging the counstitutionality of the law? The prosecutor's job is to prosecute people accused of breaking the law. If the law is found to be unjust, or uncounstitutional; the law is struck down. On the other hand, you are giving a gov't bureacrat the ability to selectivly enforce laws based upon a whim.

Stupid laws should be disregarded. Unconstitutional laws should be broken.

I don't want to hear this from anyone unless they've demonstrated their commitment to this principle by trying to board a domestic flight while carrying a firearm. Let me know how it works out...

Maybe you should get out more

Bad idea. There are already entirely too many people with Allsmiles' attitude who leave NY, NJ, and MA because their socialist ideas and socialist politicians have screwed up the economy. What do these clueless (but very very arrogant) nimrods do? The head south to places like GA and AL where state socialism hasn't completely ruined the economy (yet) and bring their moronic national socialistideas with them.

They move in and then demand more welfare, more gun control, more "public" education, more "public" housing etc. and more government thus not only do they befoul their own nests to the point where they can no longer tolerate it, but then they leave their messes behind an look for new pristine areas of the countly to contaminate with their fear and loathing of freedom and their desperate desire to be slaves of the government.

Keep in mind, that by the standards of NYC Allsmiles is a raging right wing conservative.

He should have said it was the burglers gun, the burgler turned the gun on him, in an act of desperation he grabbed the gun, fell back and as he hit the floor the gun went off, hitting the burgler.

That's not how things are done in a Democracy.

In case you were asleep in American History, and Gov't classes, I'll give you a free refresher. We live in a Constitutional Republic, not a democracy. The Constitution being the supreme law of the land, all laws repugnant to it are null and void.

In case you missed it the USA isn't a democracy. It's a constitutional Republic. Big difference - democracy is nothing be organized mob rule.

How exactly do you challenge a law without breaking it?

Challenge it in a court of law. For example, a Wine producer didn't like the Wine Sale Laws imposed, so he challenged it

However, plaintiffs in the North Carolina case successfully argued that state restrictions were only in place to unconstitutionally protect North Carolina businesses and that they served no legitimate purpose because, “they do not promote temperance, do not address the issue of purchase of alcohol by minors, they do not further state tax and revenue laws, and they do not prevent people from circumventing state laws against purchasing alcohol on Sunday mornings.” -- See Bolick v. Roberts, E.D. Va., Civil Action No. 3:99CV755, 3?29/2002, and Beskind v. Easley, W.D. N.C., 3:00CV258-GCM,4/5/2002.

Or, you can break it; then use the Counstitution as your defense. In one case, you risk losing money if the case fails; or you can risk having a criminal record.

I read on a previous thread when this story first came out that he had moved from another state and already had the gun and was IN THE PROCESS OF GETTING IT REGISTERED AND HAD PAID A BUNCH OF MONEY TO GET IT DONE. He was making an honest effort to comply with the law.

The DA has more than an ego problem. Hynes is known to be a corrupt lawyer who protects dirty NY assemblymen by not prosecuting them while going after guys like Dixon with a vengence.

Actually, disregarding STUPID laws is done all the time.

Right you are. I installed a new dishwasher in my kitchen over the weekend. Cut custom drain lines, airtraps, a GFI switch and solid core wire for power, stainless lines for hot water. Runs like a champ, doesn't leak a drop, and is a damn sight more quiet than the 20 year old chunk of junk sitting on the curb awaiting collection.

$250 to have a licensed plumber install it and another $35 for proper paper work to ensure it meets building codes and the proper permits filed. All of that ignored.

I guess that makes me a criminal.

On top of that, I don't go anywhere without my Taurus 92. No permit beyond the Second Amendment and no extra training on top of 25 years of shooting experience with 6 years of that in the Marines. I'm better qualified to carry than any cop I've ever met. Although I haven't met every cop out there.

Twice a criminal.

Oh... I own a couple books on the "banned" list.

Darn. I guess that there would be enough to put me away for about 20 years.

Iron Eagle is New Jersey's Pat Buchanan! This is what is scary. These people have become used to living this way and actually support it. They are reasonably intelligent too. Somehow the ability to think independently has been removed.

I say that it is high time we target the individuals, and hound them at home, until they decide to do something productive, and freedom loving with their lives. Let's call it something of an affirmative action program for the aspirationally challenged?

You got it. Hand out fliers to people passing by and to local merchants (store owners, restaurants etc.) educating them to that if they sell to said politician or bureaucrat that they are facilitating the person that raises their taxes, creates endless laws and regulations and makes it easier for criminals to commit their crimes. Furthermore respected business owner "we want you in our community and it is the fraudulent politician that we see as the greatest threat to putting you out of business and thus depriving you, your family and the community of a very valuable service you provide. That said, we don't want you to lose honest customers because you chose to sell your products and services to political fraudsters. You have everything to gain and nothing to lose by refusing to sell to said fraudulent politician."
