Trump arrives at federal appeals court in New York to overturn verdict in E. Jean Carroll $83.3million defamation case

Donald Trump appeared at a federal appeals court in New York as he seeks to overturn the verdict in the $83.3million lawsuit that found him liable for defaming journalist E. Jean Carroll.

The former president's motorcade was seen pulling up to the 2nd US Circuit Court of Appeals in Manhattan Friday morning where attorneys presented oral arguments before a panel of three judges - all of whom were appointed to the bench by Democratic presidents.

All phones and other electronics were banned from the courtroom.

The Republican nominee is contesting the May 2023 verdict stemming from his alleged mid-1990s encounter with Carroll

His attorneys argue that that the trial court erred by allowing in certain evidence such as the infamous Access Hollywood tape, in which Trump can be heard boasting about grabbing women's genitals, as well as testimony from other women who have accused him of sexual misconduct decades ago.

In his two-minute rebuttal, Trump's attorney John Sauer called the case 'a textbook example of implausible allegations being propped up by highly inflammatory, inadmissible' evidence.

He also reiterated Trump's claims from his testimony that the presidential candidate has never 'even met' Carroll.

Addressing the panel, Sauer called the lawsuit a 'quintessential 'he said, she said' case' that was lacking in 'physical evidence', 'eyewitnesses', and police records.

Judge Denny Chin interrupted Sauer's argument, noting the type of evidence is difficult to overturn on appeal and asked him why the verdict should be thrown out.

Sauer questioned US District Judge Lewis Kaplan's decision to allow the Access Hollywood tape and testimony from Jessica Leeds, who accused Trump of groping her on a plane in the late 1970s, to be heard as evidence.

He also argued that the statute that would deem Trump's alleged conduct a crime wasn't enacted until 15 years later.

in which Trump can be heard boasting about grabbing women's genitals,

They are repeating the same lie I hear from other low IQ people. He did not say "I grabbed". He said "if I wanted to, they would let me grab". There is a world of difference and meaning in those phrases. The main idea of the phrase he used was that he DIDN'T want to. But the money chasers or gold diggers would have let him.

At what point will Trump be arrested and detained by the DOJ? Government parasites everywhere face an existential threat if he remains a free man. Examples must be made. That’s what Butler rally was supposed to solve.(in their minds)

How could you be found guilty with no evidence, no witnesses, no security camera footage, no police report and the accuser not even able to give the exact year the alleged assault took place? If this case were brought against anyone other than Trump it would have been thrown out of court. Even the obviously phony accusations against Justice Cavanaugh had more substance than these accusations.

The most important speech a person might ever have to make is a declaration of innocence.

Declarations of innocence must be given the utmost in constitutional protection.

Civil courts created by governments must respect the fundamental right to publicly declare one’s innocence.

She kept a diary. It was not in her diary. She said she never wrote about bad things in her diary.

Then there's the pant suit. She was wearing it on the cover of a magazine. She had the date of the attack in the year....xxxx. But someone said the dress wasn't made until the next year.

And somewhere there's a sale receipt for when she really bought it. And who keeps a dress for 15 years...which carries a bad memory....but you don't write down bad things in your diary.

I think she selected that outfit when she decided to go after trump and I'm betting it wasn't 15 years old...she turned it into a prop. Remember, she was wearing tights. It's like a coat dress.

But I don't think she ever mentions him going after her boobs...but I'd have to revisit her lies.

Not just that....but NYS manufactured a new law for old, never pursued cases...The law was good for one year. Carroll filed against Trump the day after the law became effective. That’s what you call a conspiracy...and it’s a political conspiracy....and there is no doubt.

Trump’s denial is defaming her??? Is not accusing Trump of rape defaming him? And she refuses to narrow the supposed event down to a particular year.

If this country survives, this case will be the default marker for just how utterly corrupt the judicial system is in this country.

I believe she had claimed in the past that she was raped by 5 different men including CBS CEO Les Moonves. The Judge would not allow this information to be presented in court.
