A 7-year-old boy from Brasher Falls has been charged with rape.

We spoke with a New York City attorney, who is with a group that handles youth defense cases.
“Instinctually, it shouldn’t happen that a 7 year old - I don’t think you even could really realize what you’re doing at 7 years old. So I think it’s absurd to charge a 7 year old with rape. They’d have to prove he actually physically committed this act, which to me it almost seems to be an impossibility,” said Anthony Martone, Queens Defenders, felony youth defense unit director.

At seven years of age, a child has not yet developed a sufficient degree of judgment to even VIEW this a s a crime, but does understand the concept of “naughty”, and may be acting out to attract attention, even negative attention, from an adult. The mechanics of an actual rape may not yet be in place, but this is not the province of a legally constituted judicial procedure anyway, this is a child-rearing problem, and only then, if actual child abuse is involved, the courts have a basis to step in. The child has no liability here, but the parents do.

Little boys get erections. They don’t know really what to do with them unless they have been inappropriately exposed. More than just a where do babies come from explanation.
Children play sex games but I can’t see criminal charges unless the other child was much younger or was forced.
I would assume this child has been exposed to porn and was acting out what he saw. When my kids were about this age a neighbor kid was doing hip thrusts and saying “Hump me baby, hump me”. I knew what his family was like instantly and that kid fell off the friends list.
Were they playing doctor? Brasher Falls is a small town in the Adirondacks part of New York... If I recall, it is 98% Caucasian
