It takes a little effort to make any sense from this letter, but I was assured by a relative that lives in Wilmington NC that this in fact did happen. And that it has been in the local news daily since it happened.

You can make up your mind as to the "motive" for your self.

The NCHP have gotten busted doing a lot of sleazy stuff. In my naive days, I'd have speculated that these are sleazy lawyers out to make a buck.

Alas, it wouldn't surprise me if every word is true.

This incident is very serious. I expect the investigation to be revealing.

Normally, i support the police/HP 100 per cent. However, the fact that the letter was written by a lawyer(professional prevaricator) makes me want to hear the law enforcement side of the story. They’d better have a good one.

The cop indeed was angry that she “wasted his time” since she was not intoxicated. Cops today are always on DUI detail and looking to make names for themselves by always arresting more and more DUI drivers. So he was angry it probably cost him some bonus money. Then of course had to do the power play to show them who was boss.

What's curious about the leter is that it is fairly straightforward as to the facts of the incident ( as the couple relates it) but right at the end, it throws the "sexual predator" idea into the equation..as the reason for the incident.

Nowhere in her account of the events does she indicate that the Trooper in any way behaved inappropriately, or even made any suggestive comments, which he would most likely have done were he in trolling the interstate.

Not defending the state trooper or the couple but until you get an actual determination of the facts under oath with some perjury penalty potential then this is nothing more than a ‘he said’ ‘she said’ type confrontation. I could believe either side of the story if it was so determined.

I have a friend who got forced into a defensive manuever by a State Trooper then pulled over. When the trooper came back with the ticket, he told my friend to hang up the phone. Instead, my friend asked the trooper if he would like to explain to his commanding officer why he pulled the stupid stunt he pulled. The cop began to shake as he took the phone. At last word, Internal Affairs was involved.

This totally reeks of a patrolman looking for sexual favors from a beautiful woman traveling alone

I take it beauty is in the eye of the beholder. In any case I didn't see anything in the article, video or report indicating the officer was looking for sexual favors.

Two major problems with Wyrick’s behavior in this matter. Was his claim that a headlight was out valid? If not, then he pulled her over without probable cause. This fact seems to have been lost in the hype of the matter.

Also, if he told the husband to follow him to the magistrate’s office, why would he speed because he knew that he was immune from prosecution for doing so, yet the husband wasn’t but needed to follow as closely as possible to maintain visual contact with the trooper’s car?

North Carolina need not complain about budget problems with its judicial system. Much time and money could be saved if the arresting officer had the authority to release a person once that person has passed the test. If the state trusts the judgment of the officer to arm him and place him in a position of power over its citizens, why not trust his judgment to release an innocent person on the spot. The magistrates must be very busy people and very well paid.

This is what happens when you give a low IQ power hungry person with a Badge. They are in over their head and they have no business being a police officers.

All these officers should be suspended immediately without pay. Now if proven false after an independent investigation, then back pay them. If found guilty, then process them for termination. Possibly even consider felony Charges for false imprisonment, conduct unbecoming of an officer and civil rights violations.

Oh and I have no doubt the Attorneys will personally sue the officers and seek to garnish their wages. Sorry but once the woman blew a 0.0 twice the officers had no business to continue to hold her period. I don’t give a $hit how big the paper work is. That officer at that point after the 0.0 BAC had no business to hold her further.

On top of that. Since this officer was too stupid to recognize a real drunk and wasting time and money on a non case. He was putting the community at risk by not being on his post.

If I was his boss, then I would $hit can all three of those officers.

Sorry but once the lady blew a 0.0 twice then she should have been let glow plain and simple. The fact that this dipshit cop let his ego get into the way of the law

The letter was well-written and makes perfect sense.

Anyway, it will be interesting to see if the scumbag cop is terminated and the "magistrate" removed. Additionally, although the letter-writer doesn't bring it up, the other trooper who conspired with the scumbag needs to be fired as well.

NEW HANOVER COUNTY, NC (WECT) - New video released Tuesday from the New Hanover County Sheriff’s Office shows a woman from Raleigh in a heated discussion with a state trooper. It’s more evidence that’s helping to paint a picture of what happened the night of a disputed DWI arrest involving a woman from Raleigh.

The woman is Gina Tessener. She and her husband, Hoyt Tessener, claim Trooper Edward Wyrick, Jr. harassed Mrs. Tessener during a traffic stop last month. Trooper Andrew Smith is also on administrative duty during the investigation, because he pulled over Mr. Tessener while he was on his way to the magistrate’s office to support his wife.

Hoyt Tessener sent a letter to Governor Bev Perdue and numerous other elected representatives and media agencies last week asking for an investigation.

Surveillance video taken inside the Wrightsville Beach Police Department, which was released last week, shows Gina Tessener taking a breathalyzer test, where she blew a zero.

Tuesday, more surveillance video surfaced from inside the magistrate’s office at the New Hanover County Detention Center. On the tape, you can see a conversation between Mrs. Tessener and Trooper Wyrick, who seem to be arguing over the location of Tessener’s phone.

New Hanover County State Senator Thom Goolsby says he’s frustrated over what he perceives as “false allegations” against two state troopers, who have been put on administrative duty during an investigation of a recent DWI arrest.

Neither Wyrick nor Smith have any record of disciplinary action or suspensions during their time with the Highway Patrol, according to First Sgt. Jeff Gordon.

Goolsby pointed out the decision to put the troopers on administrative duty left New Hanover County short of troopers to patrol during the 4th of July weekend.

The entire text of Senator Goolsby’s letter follows:

Like most of the public, I was shocked at the allegations recently made against two local North Carolina State Troopers regarding the DWI arrest of Gina Tessener. I was sent a copy of the letter to the Governor written by Tessener’s lawyer-husband. In the letter, the husband made numerous allegations of abuse and illegal conduct against our troopers.

I read the letter with interest and concern. As an attorney who practices in our local courts, I have known these troopers for the entire time they have enforced the law in southeastern North Carolina. I have never received any complaints about them. My personal experience was that they were professional, honest and forthright.

When I learned that there was a video tape from the Detention Center, I watched it with interest. I was shocked and angered when it was apparent that the video did not represent several of the allegations made in the letter.

I have personally spoken with the Governor, Secretary of Crime Control and Public Safety and the Commander of the Highway Patrol expressing my frustration over what I perceive to be false allegations. Further, because both of these troopers were immediately placed on administrative leave, our county will be short of law enforcement officers to protect the public from drunk drivers during 4th of July weekend.

It is time that someone spoke up and defended our troopers. I am doing so now.
