Date-rape drug allegation in Duke case

The exotic dancer who accused members of the Duke University lacrosse team of raping her at a party may have been slipped a date-rape drug, according to an interview with the second dancer in the May 1 issue of Newsweek that appeared on stands today.

Newsweek also reported that a defense attorney said some DNA evidence had been found under the accuser's fingernails, but that the first round of DNA testing - which did not incriminate any of the 46 players swabbed - was inconclusive about identity. Results from a second round of tests are expected this week.

The accuser, a 27-year-old black college student and mother, said she was raped and beaten by white students on March 13 after performing for them at a house party. Two lacrosse team members, Collin Finnerty, 19, of Garden City, and Reade Seligmann, 20, of Essex Fells, N.J., were charged Tuesday. Defense lawyers have maintained their clients' innocence, offering a detailed timeline and time-stamped photos from the party that they say throw the woman's story into doubt.

You are right. The defense will shred this stupidity to bits. It cannot be both ways. She was so tuned in to the "rape" that she knew how long, exactly what was done to her and who did it...right? But she had been slipped a date rape drug? Oh my my my...

Basically, if the victim was drugged, how does one account for her excellent memory of the attackers (100%) and her violent struggles to fight them off.

And then there's the strange case of attorney Mark Simeon, who went through an unlocked door into the DAs office after 6 p.m. one night. Simeon says he was looking for a case screening list, and had a 15-minute conversation with an assistant DA while he was there. Hardin decided that was grounds to send the case to the state Attorney General's office for investigation, which referred it to the Greensboro DAs office, which found that no charges should be filed.

Well, whaddya know, Simeon, it turns out, was thinking of running against Hardin for DA. And now he is. But that has put Simeon's shortcomings in the spotlight--and they don't look good for someone who's thinking of running an office that handles more than 60,000 cases a year. He once had 55 unpaid parking tickets. He's behind on repaying his student loans. Then, last month, a judge threatened to hold him in contempt of court for failing to show up on behalf of a client two times in a row. Shortly afterward, Simeon said he was suspending his private law practice to focus on the campaign.

No kidding. They are incredibly incompetent and too stupid to be embarrased. Reporters have CGM's story and they have the players story. Why didn't they ask Kim if the went to the car as Mangum states, or if they went to the bathroom as the players do? Why didn't they ask her at what point they became separated (if they even did) and for how long and what the hell Kim was doing while they were supposedly separated?

Thanks, Maggie. It's obvious Simeon has coached Roberts for her media interviews. Plus that email she sent was not composed by her, IMO. If she's got an attorney, it's logical to assume Crystal Mangumn has one, too. Could they are very much in cahoots with Nifong on the whole deal...

I thought that one of the symptoms of a date rape drug was that you didn't remember anything... so how does she remember who raped her or even that she was raped at all?

Assuming there is positive proof of this, the accuser was in a state of intoxication when she arrived. It could have been self-administered, or it could have been given to her at one of her previous engagements (known by police). It could also have been taken during her 27 minute lock-in in the bathroom with Kim, who could have also slipped it to her. There is a long list of potential drug adminstrators.
