Alvarez's estranged wife said he threatened her and her family and threatened to abduct their 3-year-old son, although he never physically assaulted her, according to a request for a temporary restraining order that was granted Dec. 14, The Associated Press reported.
"He threatened to take our kid away and to hurt my family members," Carmelita Alvarez said. "He is planning on selling his vehicle to buy a gun and threatened to use it. He is using drugs and has been in and out of rehab twice."

Alvarez, a U.S. citizen, watched as the train barreled into his SUV shortly after 6 a.m.
"He was found right at the scene," [Glendale Police Chief Randy] Adams said. "The suspect has admitted placing his vehicle on the tracks."

U.S. Attorney's Office spokesman Thom Mrozek said there is potential federal jurisdiction with a possible death penalty in the case.

Nominated for Post of the Day.
Why not just say that if a forebear wasn't a citizen as of, oh, 1781, then you aren't an American?
At the risk of violating a corollary of Godwin's Law, McVeih was home-grown, wasn't he? Or do you think Timbo was set up? You might check your tinfoil hat - it must be leaking.
I figured he was - a citizen. Let's face it depression, numerous suicide attempts, etc.--those are American past times. Found particularly in democrats.
Not really. Just want to know on what information this reporter is basing this. It is not included in the story.
JUSTICE IN AMERICA??? PULEEEEEZE!
It's already being setup.
deranged individual who was suicidal
It's a done deal
"The court ordered Alvarez to stay away from his wife until further notice and not to leave Los Angeles County with children, the AP reported."
WOW!! That judge was a real genius!!!!! His court order kept him away from his family all right.
What angers me beyond words is the cavalier attitude the courts take toward potentially dangerous lunatics like this nutjob. This walking time bomb with such a long history of threats, violence and mental instability should have been locked up in a padded cell somewhere long before this happened.
As an aside, anyone who checks my postings KNOWS I am an outspoken opponent of illegal invaders and Bush's flawed immigration schemes.
However, if the guy's last name was O'Higgins, Romano, or Kowalski, would his citizenship have been under question??
Besides a lunatic is a lunatic and those poor people on the train are just as dead now as they would have been if the guy was an illegal invader.
Like I said - MARK THIS ONE AS ANOTHER TRIUMPH for the liberal Attorney-Court Industrial Complex we call our "justice system."
Thanks for clearing up the issue of his citizenship and setting straight some vitriolic dialogue on this subject.
I agree. See my post #99
Fourth generation legal would be quite different. Than say "anchor baby legal".
POW!
Whatever.
IMO there would be a distinction between a family legally immigrating, then raising a family versus a couple of Illegal Aliens crossing the border and then having a child.
I guess you do not make the same distinction.
Spare me the 14th amendment lecture.............
People on this thread are talking like this guy is actually going to see justice of some kind.
Prison time? Hole in the ground? Death chamber? Suicide injection? YA'LL ARE DREAMING!
NOTHING is my bet!
LOL!
Unless he does the right thing and pleads guilty, I'm sure his lawyers (which we California taxpayers will have to pay for) will have him plead insanity.
Good for you, Zulu. I agree with much of what you posted in #107.
It typically used to be 3 Generations. But that isn't taking into account the fact that Mexican immigrants don't assimilate. They actually become more of a burden to the Country as their generations expand.
3rd Generation isn't the norm anymore...that was with the immigrants that came here to be Americans.
The 3rd Generation Anchor Babies are now more involved in the hispanic LaRaza "take it back from the gringos" gang lifestyle than the American one.
I am more relieved because now he can die in the gas chamber without the Mexican government getting the SCOTUS to overturn his sentence using "international law" (Sandra Day's latest obsession)
Why would an illegal alien kill himself? There is so much to live for in Jorge bush's open-borders America.
I'd call it a hijack.
(tongue only partially in cheek)
Grin...
LOL
