I suppose you could be right, however the comment that they are busy for the next four years constitutes discrimination based on political affiliation. Plain and simple.

If this is true, let's get Drudge to put it on his page. Then EVERYONE will know. That's the best we can do. So how are we going to verify this?

Now I am even more proud of The University of Oklahoma and University of Nebraska fans that booed Tom Brokaw last Saturday night when it was announced he was at the game! It truly was priceless!

I missed that. Not surprising though, since Oklahoma and Nebraska were two of the three states where every county was "red". Go Big Red, take your pick. :) ) They were also #2 and #3 in the percent of the statewide vote for Bush. Utah was #1, the Utes really, really didn't like Kerry for some odd reason.. :)

If Drudge puts it on his page then the restaurant will be booked for the next four years. New Yorkers love to combine pate with a political statement.

"You can send a complaint to the NY City Commission on Human Rights for discrimination:

http://nyc.gov/html/mail/html/mailchr.html"

I am pretty sure that wouldn't count as discrimination (just rudeness). Are Freepers trying to expand the definition here? Private business can refuse service to anybody if not on the basis of race, sex or often age.

My table for six tonight for Dr. & Mrs. Fred Fogel and friends will be hard to serve, since I'm still 660 miles away.

http://www.nypost.com/living/32331.htm

As it turns out, Freeman's popularity is a mystery carefully cultivated by enigmatic owner Taavo Somer.

A trained architect, designer of the famed "My Boyfriend Is Out of Town" T-shirt, and a prankster who, legend has it, once laced toilet paper all over NoLIta, Somer is best known around downtown New York for knowing what people want — well before they do.

"Taavo is a pretty influential person in the downtown scene," said friend and fan Eleanor Lembo, a partner in Earnest Sewn jeans who shares office space with Somer.

Yet for all his connections and trend-spotting abilities, there are no pictures of Somer to be found anywhere online; he would not be interviewed by The Post, nor would he agree to photographs inside his restaurant.

Are you kidding? Then their business will go out of the roof!! Free advertising thanks to us.

No, you have to complain to the better business bureau, and the agencies mention in a previous post. You have to do the "stuff" mentioned right above about finding roaches. Only I would actually find a real dead roach and shove it in my food. Seriously......

If you call....ask for WILLIAM!! Don't talk to the ditzy chicky. William needs to know that this won't be tolerated and that we intend to complain without offering the restaurant ANY free advertising for the lib's in NYC.

Plastic bugs won't work, only the the real kind (dead, though) will do. :)

This reminds me of "Mouse Hunt". Remember when the restauranteur brother (Nathan Lane)lost all his business when the mayor died after eating half a huge cockroach?

Here's my "application":

Hey, great job dissing those snotty Bush Twins! How dare those Jesus Freaks ask for a table at your sophisticated, posh eatery! The nerve of those idiot children of an absolute idiot. I mean, what if Osama heard that you gave them some room at the inn. Like, he and his pals might plant a bomb in the Ladies room. That would be so uncool. Well, at least he and Al Qaeda know where you stand. Yours is the safest hot spot in NYC at this time, beleive me, er, Osama.

Hey, I hate Bush and believe that ALL Republicans are evil as well as complete dumb a$$es. They are a scourge on the earth and should be mocked and then thrown into liberal re-education camps! How any of them received a college degree is beyond me. Why any of them would deign to partake of your exclusive viands and hip ambiance is beyond understanding.

Gimme a job and I'll gladly show the world just how totally tolerant, peace-loving and inclusive we liberals really are.

Signed,

Mindy Moore-On

"Isn't this a violation of the 1964 Civil Rights Act (Sec. 201(a) ), which outlawed discrimination in public accommodations?"

A lot of cities - Seattle included - have broadened the list of protected categories to include things like creed, political affiliation, and sexual orientation. If an incident like this happened in Seattle, it would be illegal.

And Utah is a beautiful place. From Zion in the south to some of the greatest skiing in the world up north. I would love to have a cabin there. Lots of lakes with great fishing and mts for hunting deer.

Interesting. Notice the post by someone called IndianaJones:

You bunch of ungrateful commie POS in NYC: Don't expect anyone from MY police department in Texas to come to NYC and help out [on our own time and expense] next time you get attacked. You'll be on your own after this story.

You made your bed of hate, now you can lay in it.

Dear Tenacious0,

I am merely stating that the Civil Rights Act of 1964 does not protect folks against discrimination based on political preferences. Period.

That being said, if Ms. Goldberg walked into a restaurant and was refused service based on her politics, she could not sue for discrimination based on political discrimination.

However, if she were to demonstrate that screening people on the basis of their political affiliation had a significant adverse effect on a "protected class" (such as black people), then she could sue for racial discrimination, basing her claim on the theory of "disparate impact."

In the employment law field, generally speaking, there is a prima facie case made for discrimination if the "four-fifths" rule is violated. That is, if the effect of the screen has the effect of causing members of the "protected group" to have less than 80% of the representation they otherwise might have if represented proportionately to the population from which the employer usually draws. Then the burden of proof falls to the defendant to prove he has not discriminated.

Thus, it is likely that Ms. Goldberg would at least have a case, since the overwhelming majority of black people vote Democrat, and if the screen were to be applied across-the-board, if would disproportionately affect black people very severely.

However, the Bush twins likely could not make a claim, as discriminating against Republicans will not generally disproportionately harm members of any "protected class."

Even if one makes a claim based on discrimination against white people, the fact is that a large minority of white folks are Democrats, and thus, it would be difficult that if the screen were universally applied that it would have a disproportionate adverse impact on white people.

Hope that makes it clearer.
