Levin: Kobe talking plea deal for non-sex crime

According to Harvey Levin ("Celebrity Justice") from sources connected with both sides in Eagle, Colorado:

1) Kobe accepts a plea bargain for a non-sex crime misdemeanor such as Third-Degree assault. (misdemeanor, Kobe might get probation, wouldn't have to register as sex offender).

2) Kobe settles the civil case. Pays a financial settlement. Gives letter of apology saying, "that even though Kobe Bryant belived that he was doing nothing wrong, that she felt she had been assaulted in the hotel room, and for that he was sorry."

No plea deals struck, but parties talking about it.

there is now another witness that has come forward and plans to testify AGAINST Kobe.

Why do you people who insist that Kobe be hung from the nearest tree insist on posting so much disinformation.

She is NOT going to be testifying; the DA talked to her and did NOT put her on the witness list; in fact, she wants nothing further to do with this case.

And the reason Hurlburt didn't use her? Because he hit on her at a party and when she didn't want his attention, HE WALKED AWAY.

So what good would her testimony do the prosecution?

It would be great if you all actually knew the facts.

why didn't he just do this from day one?....this is a no win situation for everybody involved, including both parties, the court system, the hospital that released the vic's records and the families....not to mention its given many freepers heart attacks...

only winners are the somewhat wealthier defense attorey's , but that's what they were aiming at, eh?

Shaq disliked Kobe prior to this whole incident and is prone to making all sorts of goofy statements. Figures you'd put a lot of stock suddenly in what he has to say now.

I'm not a rape fan. Something Shaq knows about Kobe left a really bad taste in his mouth.

The woman did not initially report any of this to the police. But after Bryant was charged on July 18, 2003, she saw the news conference at which he said of his accuser, "I didn't force her to do anything against her will. I am innocent." This prompted the Florida woman to call Colorado prosecutors and report her alleged encounter with Bryant. After hearing her story, according to sources in the Los Angeles D.A.'s office, investigators from L.A. teamed with Eagle prosecutors and contacted O'Neal through his agent, Perry Rogers, and told him that O'Neal could become a witness in Bryant's case. Within hours the investigators heard from David Chesnoff, a criminal defense lawyer who said he represented O'Neal. Though the investigators assured him that his client was not a suspect, Chesnoff said O'Neal would not speak with them. O'Neal could, however, be called to testify in Colorado. (Chesnoff and Rogers told SI that they could not discuss anything related to their client.)

And just how common is that? (Talk about a nebulous statement.)

Regardless of how "common" it is, do you realize what the impact of sex after an alleged rape and before a rape exam does to the value of the evidence being used to convict a man of very serious charges?

Even if you don't, the prosecutor should.

A subpoena was required for the Florida woman because she had decided that she did not want to be a witness in a case in which the accuser has been subjected to threats and smears. Her participation is significant, though, because it could cause Bryant's lawyers to think twice before calling their client to the stand. Under Colorado rules of evidence, the Florida woman can be called as a rebuttal witness by the prosecution, now led by Ingrid Bakke and Dana Easter -- the career sex-crime prosecutors who took over for Hurlbert. John Wolfe, a Seattle lawyer who has represented a dozen pro athletes in sexual assault cases, says it leaves Bryant and his lawyers with a "Hobson's choice: If he doesn't testify, he loses the ability to tell the jury that it was consensual sex. If he does testify, he opens the door for another accuser to allege nonconsensual sexual activity."

Yes, a very significant percentage of rape claims are lies but they are usually uncovered. Most hope the victim settles out of court -- before court starts.

This woman has withstood a barrage of hatred, death threats, terrifying phone calls, and friends that sold her comments to newsrags while pretending to be her friend.

Note that this offer was never made before the 2nd witness has now agreed to testify. I'd guess that Kobe is running scared of jail time now.

Unbiased people, not bias people like you, but unbiased people are likely to view this woman as a woman Kobe expressed interest in and DID NOT RAPE. How slow are you if you think women who were not raped by Kobe testifying helps the prosecution?

Do you know what he did to her? Do you know that whatever it was he did to her that she now, after the fact, may consider sexual assualt was done in front of everybody at that party at Shaq's house?

I would like to know why Shaq won't even talk to the DA though.

That would be because literally nobody would ever dream that a woman who claims raped would go out and have consensual sex within 8 hours of the supposed incident.

Someone also my react to getting beaten up by the neighborhood bully by banging their head into a wall. That would not change whether or not they were beaten up, but it sure would make injuries not much in the way of evidence.

The defense does not have to produce anyone or anything. The evidence that she had sex after Mr. Bryant was produced by the prosecution and she lied about it to the DA.
