John J and others are great to talk to. They are the people that Jim Robinson should try to KEEP on FR. To be able to disgree civilly should be everyone's goal. Especially knowing that we may have to fight for the same cause in the dirty trenches. I know that most of us did not post on these threads to fight and make enemies. The records will show that. The disruptors were obvious..their intentions were known.

I am confident that if DW is innocent

Let me explain how this works in America. A jury decides. Then we respect the jury verdict. Surely, then, the jury trial is not the opening salvo in a discussion group where we decide it on Free Republic.

As a matter of the way things work in our democracy, DW is guilty. He has the right to appeal. But there's no need to speak in the subjunctive regarding his innocence.

I respect jury verdicts. They get it right more often, I'd bet, then judges or even us Freepers. I bit my tongue even at the OJ verdict. I figure: this is America, this is my system, I can work to improve it or I guess if I didn't like it change it by constitutional amendment, but I'm not going to set myself outside it as some ultimate judge of guilty or innocence. That would be presumptuous and indeed seditious of me. The jury decides.

So because accomplice testimony was involved in ONE of McDuff's proven many murders, that invalidates the point Richard Kimball is making?!

Sorry, I've lost track if you were one of the ones on the DW-is-innocent side or not, but if you are on that side, your reasoning on the McDuff saga explains a lot as to why.

I'm totally a supporter of the death penalty. My only concern with this case is that it wasn't totally air tight - there was the confusion about the bugs and the decay time and when the body was dumped.

So that's the only reason I have reservations about the death penalty in this case.

I think the death penalty should be for cases that are beyond an unreasonable doubt - like Avila or OJ Simpson.

Well, I am personally convinced, and I spent 6 years doing prosecutions: I know what weak cases (just barely beyond a reasonable doubt) look like and what strong cases (very much beyond a reasonable doubt) look like. This one was medium strong, well outside the infield, in my book.

Since you are a former prosecutor, I have a few questions for you; setting aside the issue of whether DW actually murdered Danielle.

1. If DW had not voluntarily permitted the cops to inspect his home, vehicles, or other property, do you think there was probable cause that would have permitted the cops to obtain a search warrant? Based on the absence of any evidence of DW in the VD home, I think it would have been very difficult, if not impossible.

2. Realizing that no one can ever predict, with certainty, the outcome of a jury trial; would you have been surprised if DW was found to be "not guilty"? Why or why not?

Oops, just read your #180 and apologize for the way I worded my last remark. I think your #180 is absolutely spot on, and I see your reaction to what has happened on FR is pretty much identical to mine. So I'll ask you more nicely, do you really think Richard Kimball's point is without merit because he referenced an accomplice's testimony?!

Do you recall the thread we were on last Friday? And the focus of the FReepmail we traded?

Look at the number of posts on THIS thread cheering for inmates to "carry out" the sentence or abuse the guilty party.

That is why the conditions in our prisons will not improve, Kim. And the irony is, now that he got the DP, he will be in the safest prison environment in CA. Unbelievable.

Those who plead for the life of the murderer depreciate the life of the victim. They pervert the distinctions between mercy and justice in order to justify their position.

Just my feeble opinion.

There are too many variables involving the bug science and exact time of death. There was a smoking gun, as the prosecution stated, and that was the little girls blood on the defendants jacket. In my opinion, it doesn't get much better than that...
