Judge denies defense motion to sequester jury

Judge William D. Mudd addressed counsel on a motion by defense attorney Steven Feldman regarding media access to jurors in the trial of defendant David Westerfield at San Diego courthouse, August 15, 2002. Westerfield is accused of the kidnapping and murder of seven-year old Danielle van Dam from her Sabre Springs home, last February.  REUTERS/POOL/Dan TrevanArguing that media coverage was creating a "lynch mob mentality" that could pressure jurors to return a guilty verdict, the defense attorney for David Westerfield today asked the judge yet again to sequester the jury.

While the jury completed its first week of deliberations without a verdict, Superior Court Judge William Mudd denied the request and a related motion to "pull the plug" on television and radio coverage of the courtroom proceedings, but agreed to set aside a private room for jurors to take breaks. Defense attorney Steven Feldman had argued that reports suggested jurors felt like they were under siege, unable to leave their deliberating room, go to lunch or walk home without being watched or followed.

"We have no assurance that they are not be intimidated ... by the presence of the media," Feldman told Mudd during a morning hearing. "We can think of only one fair resolution to that: Get the jury out of harm's way."

 

'Broccoli heads'

He cited an incident earlier in the week in which radio talk show hosts from KFI-AM 640 in Los Angeles broadcast from outside the courthouse, waving stalks of broccoli around and reportedly calling jurors "broccoli heads" for being unable to return a quick guilty verdict.

Westerfield, 50, could face the death penalty if convicted of kidnapping 7-year-old Danielle van Dam from her family's Sabre Springs home on Feb. 2 and killing her. Jurors are in their sixth day of deliberations.

Lead prosecutor Jeff Dusek disagreed with Feldman's interpretations of the jury's complaints.

"Whether or not any guilty verdict in this case would be based on a siege mentality or the meida I think is pure speculation and utterly false in this case," Dusek said.

What the jurors had complained about was being watched all the time, he said.

"That hardly equates to being under siege," he said.

 

Trust in the jury

Mudd dismissed most of Feldman's concerns, saying that the jurors had only asked a bailiff to keep reporters a little bit farther away, though an alternate juror reported that he or she had been followed to his car.

Media coverage has diminished since the jurors began deliberating, the judge said.

"The synopsis programs on the two local TV networks are not in place," he said. "The talking heads are doing nothing but speculating about what the jury may or may not be thinking."

Mudd said there were no signs that jurors were being harassed by the public, especially since their names and faces haven't been publicized.

"We've all sat here and picked this jury, know their makeup and know their dedication to this cause," Mudd said. "I would prefer to think that any verdict they make in this case would be based upon the evidence."

Sequestering the jury also wouldn't protect them from any public reaction to the verdict, Mudd said.

 

'The activities of a few'

"The tragedy is, the majority of the people in this courtroom are abiding by the court's orders and working very hard to insure they, meaning the media, do not cause something to occur that is going to cause a mistrial," Mudd said. "Not all of them feel that way as is very apparent with the activities of a few."

Mudd took aim at two radio program hosts from Los Angeles who he previously described as "idiots."

"I suppose it's entertainment out of LA. I hope it stays in LA," he said. "The shows those two gentlemen put on made the court incredulous as to what they were attempting to do."

Gee, I wasn't going to do this. At the PH virtually none of the tests were back and the objective was to give enough information to hold DW over for trial.

The Forensic Dentist didn't give the same answers at the trial, and Jeff Dusek, esquire was NOT best pleased.

There is no doubt that BVD and DW had something going on. Did you see how she waved and looked at him in the first days in court, in PH?

Even Damon looked quite kindly at him and only later went ballistic AFTER I pointed out how neither Van Dam looked at DW at all as if he were someone who had harmed their daughter.

You know what I started doing? Just on principles,I got into the habit of stopping on the way back to the hotel every evening and buying something. No huge purchases,but something every day,so that I had a dated,timed receipt that would place me at a specific location,at a specific time. It wasn't much,but it was something.

To me, it's a "could have". Just like it "could have" identified any one of the others in the "genetically diverse" population group.

There are some 3 billion possible pairs in a complete DNA strand. The estimate is about 80,000 of those make a human being, the rest is useless baggage left over from evolution (and no, I'm not gonnin get into the C vs. E flamage).

Current thinking is 20,000 - 30,000 of the pairs make a unique individual. The remainder are more or less "generic" -- how to make liver cells, bone cells, skin cells, red blood cells, etc.

So an identity match looks at the group of pairs that relates to an individual :

male - female ?, hair color, eye color, blood type, alcohol ametabolic, sickle cell , drop earlobe, etc ...

So far 25 markers (pair sequences) have been proven to be unique to an individual and accepted in court.

So if you can match "female, black hair, O negative, brown eye, no drop earlobe" -- you now have 5 of the 25 markers; and a very good ID of a body.

If you the come up with another 7 or 8 (12-13 total) that's just about ironclad.

yes it's within the range..and was a bit deceptive IMHO. ;-)

It must take atty's years to learn when to say "objection, leading the witness" ha ha... They've pulled us this way and that...for months. Still are!!

I agree! I do hope the reporters spend some time interviewing the jurors so we can know what they were thinking and discuss it here.

Truly, if I could change anything with the courts, it would be to allow the jury to hear whatever they want to hear and to ask their own questions of the witnesses.

Remember Damon's wild trip through the desert beginning before sunrise and passing by Dehesa on Feb 16th? On Feb 18th he told searchers to please look closer to San Diego. The body was dumped around the 16th in a place that was not really a good hiding place near a golf course and casino. Like it was supposed to found pretty soon .... need the insurance money? Why did he get rid of that van? Needed a new BMW to help ease he's pain?

Well, I didn't talk about it before - but I passed out when I got home. But not before I'd put bacon on to cook. I set the kitchen on fire. As you can see, it was a pretty traumatic experience for me.

Was the shot originally intended for one of those young people they were trying to pick up and take home to abuse? Could it have been a date/rape drug?

I believe Danielle died on the second floor of her home, with no human intervenors but her parents, whether through drugs, violence, or some combination of the two...

I would not be surprised if the later-shredded dog bed was used to transport her out of her home, and possibly onto DW property or vehicles.

Actually, there was no shortage of flies.

IIRC, the possible explanation offerred about the lack of fluids was, I believe, evaporation. I'm not sure who offerred that possible explanation (Haskell?), though.

I do recall that either Faulkner or Haskell or both went back to verify with the ME and/or LE that there was no indication the body had been moved, as in "are you sure the body wasn't moved?"

It's good to try to think like a juror! If I were a juror, I'd be going nuts with questions which were not addressed in the trial. One being "Where are the PJ fibres? Did you even find them in her bed? You sure didn't find them on her body!"

I'm paraphrasing there from the greatest book..
but theres nothing wrong w/ being prudent. Though, it is kind of scary when you think about it...things like that could happen to anyone of us.

If DW is innocent,imagine how this has destroyed his life. Not that God couldn't help him to recover, but if he is truly innocent, he must be going through hell on earth!

I know I live everyday praying for God's grace in my life.
I think though, there is a lesson learned here, AVOID people who engage in unsavory behavior, like the VD's!!!!
