Jury's time
Jurors will resume deliberations Monday in the capital case of David Westerfield, who is accused of killing 7-year-old Danielle van Dam


DAY TWO: FRIDAY, AUG. 9, 2002
12 noon ET    Jury enters jury room.

2:30 p.m. ET    Jury goes home for the weekend.

DAY ONE: THURSDAY, AUG. 8, 2002
1:10 p.m. ET    Jury begins deliberating. After two months of testimony, the capital murder trial of David Westerfield is in the hands of the jurors, who began their deliberations following more than two days of closing arguments.

2:50 p.m.   Jury sends a note to the judge.

3:00 p.m.   Jury at lunch.

4:30 p.m.   Judge calls the lawyers but not the public or the press into the courtroom.

5:15 p.m.   Judge says jurors sent note asking to deliberate five days a week instead of having Friday off and he approved their request.

7:00 p.m.   Jury goes home for the day. Will return Friday morning.

Exploding heads---You've got me laughing... If not guilty or even a hung jury..

Lets see: Nancy Grace will probably do a Linda Blair-360, she'll probably even spew green pea soup. The big question is what will Brenda do? I say, she'll fight for the cameras and put on a "BIG" cry scene, and state that DW is guilty. She'll also say that the soul of Danielle will never rest until that man, DW, "pays". Later, a few months will go by and then Brenda and Damon will file civil suit against DW for wrongful death. That will give alot more TV time for the Van Dams which will increase the value of their written story.. Wha-cha-think....

The sketch is only 3 years old so I don't buy the 'baby fat' argument since Damon is in his late 30's. I'll admit that the eyes and nose appear identical but I still have a hard time convincing myself that the sketch identifies Damon. However, I was more inclined to believe that the photo identified Damon when I found out that Damon knew the kid that disappeared.

That's Torgerson (I think.) His testimony comes immediately after the drycleaning clerks' on June 16. I know for certain that there are THREE receipts dated 2/4. One at 9:44 a.m. for a "sport jacket." One at 10:55 a.m. for bedding. One at 1:40 p.m. for the black clothes.

Feldman held up a receipt during his closing for a "Jacket" dated 1/26. That was not ever in testimony, as far as I remember.

I think that if he is acquitted, this case will never be solved.

The VD's may write a book, because they can sanitize their lifestyle, but NO WAY would they go after DW personally...They're "whole life" would be open to scrutiny if they filed a civil suit against DW.

Now, on the other hand, DW may be able to make a claim of "malicious prosecution" or something of that sort.

Due to the fact we are awaiting the jury's verdict, I am stuck with Court TV on in the background, but I gotta say, they are grating on my nerves!

They keep trying to jusify how lousy the prosecution's case is when they continue to say things like, "Jeff Dusek and Woody Clarke are classy attorneys, have a good deal of credibility, blah, blah, blah."

We think one of our cats is part Maine coon. He spends every morning on the hallway rug sprawled out, trying to bite our ankles. He's so funny and he's done it every since he was a tiny kitten.

He just wraps himself around and playfully bites and bats at our ankles.

Never does it in the afternoon. Is that like the 'tripping' behavior you're describing?

We now return to all the VAn Damned, all the time, starry Nasty Grace. LOL

Well, the VDs can do a media blitz if they want if he is found not guilty. They just might want to remember that DW won't have a gag order on him anymore either. Would love to know what DW has to say about BVD and their conversations that night at Dads.

Court TV hosts & commentators keep talking about the "emotions" involved in this case & the jury "will" reach a verdict on those "emotions". Well, I guess they (as attorneys) have forgotten that a jury cannot reach a verdict based on "emotions". It's stated as such in the jury instructions.

According to them, they have already done that. I agree that there is still more about the VD's that we don't know and probably will never know. Likewise, I believe that incriminating evidence in the VD home has been done away with, so what more could be discovered about them? Of course it's possible that it could be shown that they (VD's) are long-time swingers, but what's new about that. Anyway, I think they lots of swinging friends that will cover-up with them.

Also, a claim of "malicious prosection" would go against the county of San Diego- wouldn't it? I mean Brenda didn't prosecute DW did she??? I don't know, I'm just asking...

That's like someone guessing anytime after Monday morning. A pool selection like that is not valid in my opinion.

My guess for jury deliberations to end is Tuesday mid-afternoon and sadly with a guilty. Why ?

Because tee vee advertising works. That's why scum like Nancy Grace remain employed. Tee vee people like her will have the innocent blood of a man on their hands after Tuesday mid-afternoon. Bugs don't lie, Westerfield is innocent. Pressure by tee vee media works and DAW will be convicted.

Does anyone remember how long the verdict took in the Skakel case? The media did not think he would get convicted, but once again they were wrong. I hope they have "read the tea leaves" wrong in this case too, and DW is found not guilty.

We had a part "Maine Coon" cat too, very large, and quite a character. Beethoven would BOX our legs if we didn't feed him soon enough. And then there were his criminal tendencies: we often said, if there's such a thing as reincarnation, this cat was a godfather in another lifetime.

My Maine Coon was strickly an indoor cat. I would take him out the back with me, but more often than not, he'd want back in the house before I was ready to come in.

These cats are the State Cats for Maine. I don't think any other state has a state cat.
