Smart Case, July 30, 2002

Time Line
06/05/01 Tuesday Ricci steals items from the Smart home while he is employed there as a handyman. Ricci is charged in July of 2002 of 1 count of theft related to the Smart incident.
05/30/02 Thursday ~ Ricci returns to pick up his Jeep at the auto repair shop before the shop has a chance to fully fix it He tells the repairman that it needed for an emergency.
06/04/02 Tuesday ~ Ricci is at work from about 9am to 5:30pm
~ Ricci claims he spends the evening with friends
06/05/02 Wednesday ~ 1:05am - 2 cars are spotted on the SLC Shriner's Hospital Parking Lot by a hospital security guard, two blocks from the Smart residence
~ 1:30am (approx) - Elizabeth is kidnapped from her home
~ 1:30am - Ricci claims to be in bed asleep with his with wife.
~ Ricci is scheduled to be off work all day today.
~ 7:21am - Rachel/Amber alert is issued and national media is involved.
~ 8:30am - Ricci and his neighbor talk about the kidnapping of Elizabeth, Ricci seems to know too much information about it.
~ Sometime during this day Ricci is visited by police in regards to Elizabeth's kidnapping as reported by Angela Ricci (Richard A. Ricci's Wife which is an ex-convict herself)
~ Ricci is seen by his neighbor digging a hole by his (Ricci's) trailer early in the morning. (heard the neighbor say this on TV)
06/06/02 Thursday ~ Ricci is scheduled to work from 9am to 5:30pm today, but instead works from 10:30am to 7:00pm
~ Police talk to Ricci this day about the Elizabeth Smart kidnapping. (The media is reporting this, so it could be wrong)
06/08/02 Saturday ~ Ricci returns the Jeep to the repair shop to get it fixed. The Jeep is muddy and the repair shop owner sees Ricci remove seat covers from the back of the jeep and place them into a plastic garbage bag that already contains other stuff in it. Also the repair shop owner said a muddy post hole digger was in the back of the Jeep, Ricci removes this also. Ricci has a man waiting across the street to give him a ride. Ricci takes the plastic bag and contents along with the post hole digger with him. Also there is 500 to 1000 extra miles on the Jeep since Ricci picked it up on May 30th, 2002.
06/14/02 Friday ~ Ricci is taken into custody for a parole violation, this being drinking while on parole and association with other ex-cons.
07/11/02 Thursday Formal charges are filed against Ricci (2 counts of theft & 1 count of burglary) on the theft & burglary of the Smart neighbors home which occurred in April 2001, and 1 more count of theft for stealing from the Smart home on June 6th, 2001.

That one is still in use. We used one like it for a very long Picket Fence. But online, all I could find was hydraulic ones or gas ones, and those didn't have a picture for illustration.

Even so, unless you have one on a tractor mount or a huge one like the miners had...they will still only dig a 6 in. hole one at a time.

It is absurd to think that Ricci, or anyone else for that matter used a Post Hole Digger to dig a grave.

It's the same way as drug dealers hang out in slum areas, rich people live in elite areas, they learn to run shovels, work for minimum wage or less than minimum wage to get started by contractors for experience. As you know, once they get the "experience", they move on up..it's all part of the game. 9 times out of 10, they tell the contractor the truth about being in jail, need work, have a family, etc., so they get the job and the contractor is aware. The con WILL do a great job because he's given a chance to prove himself and work's his way back into society.

Maybe someone who uses a post hole digger to dig post holes can join in on this issue

I've used a post hole digger to dig out holes for a fence and a shovel to dig large holes for a septic system. I would never use the post hole digger for digging the large cascading holes, one flowing into the other.

It just doesn't make sense. And I'm sure someone in the landscape business would use the proper tools for holes.

Have a question, didn't the milkman supposedly give a description of a car that was supposedly floating around the Smart's neighborhood that turned out to be a false description along with plate numbers that turned out to be incorrect?

The milkman saw a white Honda or Nissan and I think remembered the 3 numbers on the plate that matched the three numbers on the plate later seen on Edmunds car. That licence number was not registered in Edmunds name and police indicated as I recall it was not a valid plate, the number was not in the DMV database. Probably a set of phony plates the boys made up at the big house. This would indicate to me the guy seen by the milkman had been out of circulation for a while and didn't have a valid plate or wanted a set that wouldn't tie to a registration under his name so he borrowed this phony set to commit his crime. This would be why the police wanted to talk to Edmunds. If Newhouse' testimony is true that she saw Edmunds with Ricci in his Jeep on Jun 2 at her home this would tie Edmunds, the driver of the white Honda or Nissan, and Ricci together. Small world among junkies, isn't it. Wonder who this 3rd person is?

It would be easier for him to put the money in a safe deposit box, wouldn't it?, she said, agreeably. But he has a problem -- can't go into banks without robbing them. Voila! Problem solved with a post-hole digger! Hope it's all in large bills so it'll all fit in the hole. :-)

This explains the strange directions. :-)

SG...go back to post # 29...they did not follow what they were suppose to, (workers), and Smart should have know the law. He hired them.

By the way...does anyone know who gave this advise to Mr. Smart that Ricci was good to hire ?

And there is only a 5 ft. handle on either type of Post Hole Digger. So you would be capabale of digging only a 3 ft hole...or jump into the hole to continue !!!!

I would have to use either post hole digger to dig a hole big enough to believe a theory that Ricci could have the time to do it all and get back home...using a post hole digger to dig a grave ! LOL !

Two made two bogus assumptions.

1) Three feet is more than enough to conceal a body for years.

2) You are still assuming that he had to be home by 6:00am when Angela woke up. That isn't necessarily the case. He could have buried the body several days later - like on the 8th when he returned the Jeep WITH ALL OF THE WINDOWS OPEN.

Well, he denies he was making a fence for anybody, you figure it out. Ricci being a professional would probably use the 2 handle type where you force it in the ground and spread the handles apart to lift the dirt out and this would explain how Moul knew what it was from a distance. Also Ricci may have borrowed the post hole digger from his company or someone and needed to return it whereas he used his own shovel and dumped it on the way back.

You are assuming that Ricci knew that he would be burying a body. If his accomplice killed ES, which would account for Ricci's extremely sour mood when he returned the Jeep on the 8th, he may have had to use the tool(s) he had available.

I don't have any love for Ricci, but my instincts are that he wouldn't have been party to a plan to kill her from the get go.
