The Truth Social post by dhwright is exaggerating a bit.
He’s referencing the December 18 decision by the USSC which left in place a ruling by a federal judge in Chicago that barred the Trump administration from deploying National Guard troops in Illinois. In deploying 300 members of the National Guard to Chicago in early October, Trump relied on a federal law that allows the President to call up the National Guard for federal service when there is an invasion or a rebellion or danger of rebellion, as well as when he cannot āwith the regular forces ⦠execute the laws of the United States.ā
The state of Illinois and the city of Chicago went to federal court to challenge Trumpās decision to deploy the National Guard there. On October 9, US District Judge, April Perry, issued an order that prohibited the federal government from āordering the federalization and deployment of the National Guard of the United States within Illinois.ā This was appealed to the Supreme Court.
A USSC majority spoke to two issues. One was the use of the National Guard and the other was the term “regular forces”. They concluded “that the term āregular forcesā ⦠likely refers to the regular forces of the United States military.” The majority said, āthat to call the Guard into active federal serviceā under the law on which Trump relied, the President ālikely must have statutory or constitutional authority to execute the laws with the regular military and must be āunableā with those forces to perform that function.ā
So the USSC confirmed that PDJT cannot use the National Guard unless he’s unable to to enforce the laws using the regular military. However, they noted that he must have statutory or constitutional authority to execute the laws with the regular military. The use of military forces in U.S. cities is generally prohibited by the Posse Comitatus Act, which prevents federal troops from acting as a domestic police force unless specifically authorized by law. A notable exception would be following invocation of the Insurrection Act.
