Accuser of former Penn State football coach Jerry Sandusky expected to recant testimony

Jerry Sandusky is due to return to court next month as one of his accusers is expected to recant his testimony against the former Penn State assistant football coach who was convicted of sexually abusing boys for more than a decade, according to an affidavit.

A judge scheduled an evidentiary hearing for Sept. 8 in Bellefonte, Pennsylvania.

Sandusky, who is now 82, has been serving a decades-long prison sentence after he was convicted in 2012 of abusing boys.

An accuser known as Victim 10, who testified for the prosecution at Sandusky's trial, is now prepared to tell the court Sandusky did not abuse him.

Victim 10 alleges prosecutors coached him in order to steer his testimony and asked him to revisit and reframe his allegations, writing in a sworn affidavit provided to the defense that "[t]hroughout the pretrial process, I was told -- both directly and indirectly -- that trauma may have fragmented my memory, and that I could safely affirm details I did not fully recall. I was assured this was common and even expected." The Pennsylvania Attorney General's office is expected to address the allegation at September's hearing.

Sandusky should sue somebody if freed. His life is ruined. Not sure if he can do that.

The McMartin case was the SoCal one I was remembering, see the link in #23.

That was in CA, IIRC. McMartins. A mother and her son ran the daycare.

Yes, Bo was one of Woody’s position coaches before heading off to Michigan. My cousin (who lives in that part of the world) thinks offensive line.

Sandusky’s own coaches turn him in for sodomizing children in the team shower. But it’s good this child’s testimony is reevaluated.

If one out of ten doesn't change the outcome, I'll continue to refer to Penn State as "Pedophile State."

There are several severability doctrines in law. It is commonly found in contracts, civil liability cases ( example: the defendants are jointly and severally liable etc.) In criminal cases, the courts can sever the convictions and sentences where there are multiple victims. In the instant case, the victim (victim 10) is claiming that his testimony was the result of undue influence. It remains to be seen (through an evidentiary hearing) if the prosecution coerced the other victims.

As an aside, the Centre County DA, Ric Gricar, declined to press charges against Jerry Sanduski in the late nineties. In the mid-2000s, Gricar disappeared. His abandoned vehicle was found in Lewisburg PA along with cell phone. His laptop and hard drive were eventually found down river from Lewisburg. He was never found.

I was interviewed by him. It was the strangest interview I’ve ever had. It was scheduled for around 7am on a Saturday morning. I met him at the front of Centre County courthouse. He showed up late, looked disheveled, and he appeared to be sporting a buzz (under the influence). The interview was to take place in the courthouse. Unfortunately, he said he forgot his keys to the courthouse. He also forgot my name. We chitchated a bit- perfunctory pleasantries and I left. As I left, he said he’d call me. I thought to myself, don’t bother. I never heard from him again.

9 others, IIRC.

Over forty charges.

And Penn State was accused of covering up for Sandusky.

If there was nothing ro cover up, why do it?

And Ray Gricar is still missing...

I have a home in Lewisburg, on the edge of Bucknell University. I remember the events as this was unfolding.

Thanks for adding the details to refresh my memory, and to the notes related to severability in criminal cases. My exposure to criminal cases has been limited during my career except for a few fraud cases.

Sounds like we both haunted the same stomping grounds in Central Pennsylvania.

I seem to recall North Carolina (home of Mike Nifong) as well. I think the surname of the falsely accused day care facility owner was Kelly,

I lived on Market Street (next to the French restaurant) and later on Saint Louis Street in Lewisburg.

I always worry about this in these kind of cases when suddenly multiple people come forward many years later.

I knew him back when he was the public defender, then judge, and then he disappeared. His office was on one side of a restaurant and mine on the other, so we would often see each other at lunch.

Ran into him at a mutual friend judge’s wedding he officiated in Key West and got an update. That’s when I found out he disappeared to do the grand jury work. Always liked him as being very fair on the bench.

Good chance we know each other and have a lot of acquaintances in common.

Graham, Pete, Judge McClure, Lonnie, Paul, .....

It is a small world.

Nifong lived in my neighborhood at the time of his demise and his family did the litter pickup on the road to my house. I used to smile evetytime I drove by the sign and imagine prison uniforms picking up litter.

I knew him when he was a judge and Ranck was the president judge. Feudale was an extremely honest person as well as intelligent. He also had a very good sense of humor.

He was judge at the same time as Rosini. Tony was previously DA and Barry was public defender so they balanced each other.

I knew Tony when he was an assistant DA. The others in that office were Cole, Stuck, Targanski (sp?), Best, and the DA was Sacavage.
I used to go shooting, among other activities, with Feudale’s law clerk in the abandoned coal fields near Centralia.

“A Shower of Lies: Spanier, Sandusky, and the Mess at Penn State” A Shower of Lies: Spanier, Sandusky, and the Mess at Penn State | by Frederick Crews | Medium https://share.google/IwLqWI4VCEsuVCitO
This is a very comprehensive, detailed article on the problems with this case.
It includes statements by the prime victim that Sodom never happened.

Thanks for this. At the time, I thought the accusations were made for financial gain. This confirms that an idiotic board of trustees invited a couple of ambulance chasing attorneys to find victims of crimes that never happened, and then a fascist AG engaged in prosecutorial misconduct to convict an innocent man using an emotional appeal about child abuse. It's an indictment of the PA's attorneys and lack of any ethical enforcement for lawyers. The AG prosecuted the case and withheld exculpatory evidence until the last minute, and the judge refused to delay the trial or permit Sandusky's attorney to resign from the case. The judge did what he could to guarantee Sandusky would be convicted, and that's without addressing that the prosecutors and the ambulance chaser hid the location of Allan Myers, the kid who Mike McQueary saw with Sandusky in the shower have a towel fight.

I believe that more than one kid was coached to lie about Sandusky, and many profited handsomely from settlements from Penn State. Many kids grew up without fathers because of the moral problems of their mothers, and that affects their children's morality as adults. When the prosecutor wants witnesses to lie, and works with an ambulance chasing attorney looking for clients and a big pay day, this is what results.
