Jeanine Pirro seeks to drop charges against Olympian David Hearn, admits reflecting pool damage was ‘flawed installation’

DC US Attorney Jeanine Pirro is moving to dismiss charges against former Olympic canoeist David Hearn for allegedly vandalizing the Lincoln Memorial Reflecting Pool, revealing in a Friday court filing that the damage was, in fact, “the result of flawed installation by the contractor.

Pirro’s office submitted the motion to dismiss after Hearn had pleaded not guilty earlier this month to one felony count of destruction of property for the alleged June 19 incident.

Those very words set my teeth on edge. The only cause of action against the government is malicious prosecution. As far as damages against the prosecutors did go, prosecutorial immunity. Even if you clear the massive hurdles, no punitive damages against the government. I peg the value of this case around $50K. Lawsuits are not lotteries unless you’re a minority POS whose criminality causes the cops to kill you

Sorry for the dumb acronym.

Blaming it on judges is absurd. Burgum and the rest of the administration (including the President) assured us of evidence of vandalism. But earlier this week, the government’s own expert witness testified the job was botched.

The judges today were the judges when the charges were filed and when Pirro won a grand jury indictment. If the concern was the inability to convict, better not to have prosecuted it in the first place rather than to embarrass the office with today’s abject surrender.

This case fell apart both from lack of evidence against the defendant and the government’s own evidence that the damage came from the ineptitude of the contractor.

Perhaps a bit of sanity.

I left this place for ten years because of people who, despite seeing what happened, their president driving a motorcade across the reflecting pool like the emperor without clothes will die defending this insanity.

The pool wasn’t broken before he ruined it with his no bid repair job using an old crony for the job. Now, once again, the blame must be else ware because the buck never stops at the top.

Only thing that the top takes responsibility for are wins.

No, the person who cut the 350 gash hasn't been caught yet. This guy was ripping out the lining that had been cut away.

Obama spent $34 million “fixing” the pool leaks. It still leaked

The structure of the pool, the soft ground below it and it’s age make it hard to completely fix it.

Except nobody cut a 350 foot gash in the pool or ripped out any lining. According to Jeanine Pirro herself: “It is difficult to attribute the widespread damage to the Reflecting Pool to vandalism, let alone to establish that fact beyond a reasonable doubt...The damage was the result of a botched installation and not vandalism as initially represented.”

From what I understand, Hearn simply bent over on the side and reached into the pool to touch and examine a piece of the lining that had already come up due to the shoddy work performed. I hope he sues for malicious prosecution and wins.

Unfortunately, we taxpayers will pay for that instead of the individuals who should be on the hook.
