What sort of ‘technicality’ could there possibly be that would move a judge (even a DC judge) to dismiss the charges?

What sort of ‘technicality’ could there possibly be that would move a judge (even a DC judge) to dismiss the charges? They can just make up something. Like "unreasonable search and seizure". It doesn't need to make any sense. Everything depends on the venue.
We live under a pretense of law. No DC Court will convict Cole Allen of anything more serious than littering.

Not necessarily dismiss out right but possibility. I didn’t have a specific one in mind as my point was more that a technicality could be used by the defense to lower charges or dismissed them.
