I had something similar happen. The company I worked for way over paid me one week, but the timing and amount made it seem like possibly a bonus. So I started asking questions and found out no one knew why I got it. So I went to the bank and locked my account—and it was good that I did because the company tried to claw back twice what they paid me which would have taken every penny and then some. This led to some nasty phone calls accusing me of stealing and I calmly told them I would write them a check for the over payment. After about 2 weeks of this nonsense, I finally wrote them a check for about a third of the overpayment because thats what their payroll department determined was how much I was overpaid. The reason they were angry? I locked my account when I figured something wasn’t kosher.

She may be jailed, but she could be unlikely to be convicted even if she keeps the money. State laws don’t always favor the over-payer.
Why does she have to return it? The employer can simply fire her, if she won’t return it. She very well could have spent it.

I would think the business would have a hard time recovering that from her. She didn’t steal that money. They gave it to her for work performed, and then tried to come back on her for it at a later date. There’s a big difference. I think with the right lawyer, she’s home free.
I got a really expensive mower from Lowes one time for 1/3 the price. The correct price was clearly marked, they loaded it on my trailer, and I headed down the road. But, they only charged my credit card less than half price. When we got home, we got a call from Lowe’s telling us we owed them money or the mower, and told me that if I didn’t get right with them, I committed theft. I told them good luck proving it, because they gave me that mower for what I paid them. I didn’t steal it. I never heard from them again.

Typos happen, my former company send billions to some supplier by the way of typo.
Luckily the supplier was honest and they worked it out eventually. But it was huge boo boo.
This woman is stupid.
If she worked it out with the company, everybody would be happy and she would likely got some bonus.
