Trump is right to reconsider NATO. Under Article II, the president has full constitutional authority to withdraw from any treaty without Senate approval. The 2023 Kaine-Rubio provision can't override the Constitution. It's his call to make.

The Constitution says nothing about how to exit treaties, so that power remains with the president. The Founders designed it this way deliberately: hard to get in, easy to get out when an alliance no longer serves America's interests.

Trump is forcing the conversation Washington refuses to have: do our alliances benefit America, or just trap us indefinitely? Alliances should serve our interests, not the other way around. Fair burden-sharing isn't isolationism. It's sanity.

This is one of the few issues that I’m with Rand on. NATO is now controlled by Leftists, Europeans, and Trump-haters. There is NO REASON for Trump to be dealing with them.

And to you Zeepers: NO, the Big Bad Wolf from the East has no interest in trying to occupy a bunch of countries halfway through their Death Spiral. It was draining enough even when they imposed their own leaders on Eastern Europe.

As ugly as it is one can make the argument it is better for Russia to have more influence over Europe now because the elite there are turning it over to muslims.

At least Russia is less tolerant of Islam, we are stuck with choosing the lesser of two evils.

Someone brought that point up yesterday. I think if that provision were challenged in the courts, it would lose.

Much as I despise arrogant, condescending Europeans, I don’t see much advantage in leaving NATO.

Our weapons systems and military people should be able to work with each other’s.

Ordinary Europeans are pretty sound people on a personal basis and I assume it applies to fairly high level (captain?, major?) up in the European militaries.

Point of Order: why doesn’t the Kaine/Rubio provision apply?

Rand seems to think that there is an implied Constitutional authority to terminate treaties, yet the Constitution is silent on this topic while also expressly granting the authority in Article II to make treaties (provided that the Senate concurs).

I would argue that the Constitution is a document that outlines all legal authorities and functions of the Federal Government, and isn’t a document of prohibitions: those are implied by their _absence_.

Therefore, if there is no mention of an authority to kill a treaty, then it does not exist... or at least does not lie solely with the President. Therefore, the Kaine/Rubio provision should certainly apply. At the very least, such an act would be litigated strongly.

(P.S. - yes: I think NATO has worn out its welcome... but that doesn’t mean we can break law to break that relationship).

That is my assessment regarding the war in Ukraine.

If Zelensky refuses to make a deal, we should be like Pontius Pilate and wash our hands regarding the war.

If Germany, France and UK are up for it, they can continue to support Ukraine to keep them afloat.

as of 2023, U.S. law requires Congressional approval for the United States to exit NATO. A bipartisan measure passed in the 2024 National Defense Authorization Act mandates that a president must obtain a two-thirds majority in the Senate or an act of Congress to suspend, terminate, or withdraw from the treaty.

Are we sure Trump can exit NATO on his own?
