“Judge strikes down restrictive Pentagon press policy, finding it violates First Amendment”
CBS ^ | Jacob Rosen, Joe Walsh

Posted on 03/21/2026 5:36:36 AM PDT by MrRelevant

“A federal judge has struck down some of the Defense Department's strict controls on how journalists with access to the Pentagon are allowed to report — ending a policy that caused many news outlets to leave the Pentagon. U.S. District Judge Paul L. Friedman sided with the New York Times and a reporter at the newspaper, Julian E. Barnes, who sued in December, arguing the new Pentagon policy violated the First Amendment, Fifth Amendment and due process provision of the Constitution.”

So apparently folks who have been proven to be fake news, enemy propagandists really have been allowed by this judge to set the rules in Pentagon press briefings?

It’s a lefty ruse.

OPSEC is in play here, and OPSEC overrides any idea of both CLASSIFIED & UNCLASSIFIED being released in any way, shape, or form.

That just means it is time for the Executive Branch to start setting the rules for the Judicial Branch.

Remember, co-equal branches of government? If one can do it to the other, then the other can do it also.

Just don’t talk the press then. They ask a question, “No Comment”.

+1

There’s obvious judicial encroachment and deliberate obstructionism against a duly elected president, but Republicans just won’t push back against the weaponization of the judiciary. Nor will Republican judges do the same to Democrats.

Democrats only care about one thing: POWER. They have no fear of resistance or retribution so nothing ever changes. Unfortunately, “our side” simply lacks the will to fight back and defend the core principle of co-equal branches of government.

This will, of course, be appealed. I don’t expect this ruling to stand. There is a long-standing principle that can be summed up in a single sentence: “the Constitution is not a suicide pact.“. The very idea that the Department of war cannot set limitations on information disclosed, when such information given to our enemies will result in our personnel, dying, and the possible loss of a battle or a war, is insane. This ruling will not stand.

Where is the GOP Congress re: Judicial Oversight on these issues? (yes, that's rhetorical)

SCOTUS will overturn. The Pentagon is the National Command Headquarters for the US Armed Forces, and the 1st Amendment is most definitely not absolute right.

NYT does not support USA. So no access.

Bad argument.

Press briefings conducted by a private or public entity should be able to be conducted by the hosting entity as the entity chooses.

The press is free in the sense that they can publish whatever opinion they have about being excluded - suppressing THAT would be a First Amendment violation. But a "right to attend" a briefing that would impose space, time, and content burdens on the briefer?

That's going too far.

Democrats only care about one thing: POWER.

You say that like its a bad thing.

POWER is the purpose of politics. That Republicans do not care about power, that they are in fact in a sort of perverted way opposed to taking and using power, is not the fault of the Democrats.

Not sure what the First Amendment has to do with access to government. My understanding is that it only applies to the right of the media to publish what they want.

The reason Democrats so desperately want power (and will do anything to get it) is simply to control people. Their goal is tp expand government’s reach into virtually every aspect of our lives. They are all the things that Reagan warned us about. Republicans on the other hand tend to want “power” in order to keep government from dominating our lives and turning us into a complete nanny state.

Power is a bad thing in the hands of people who intend to abuse it. And that’s something that the Democrats have clearly shown, even if it takes destroying our borders and importing voters to do it.

“POWER is the purpose of politics.”

In North Korea maybe.

Find that in the Constitution plz.

We have a representative republic. Not a communist dictatorship.
