Amendment XXII says, in plain language, “MAY NOT BE ELECTED MORE THAN TWICE”.
It says nothing about serving, being inaugurated, or being sworn in.
If a court rules that Trump was elected in 2020, his service will be over.
That just isn’t going to happen.
Are you hoping for that?
Such a ruling seems unlikely since, after careful (albeit perhaps panicked) deliberation, Congress decided he was not elected and allowed someone else to take the office.
But, of course, a federal judge in an 80-page opinion may now say, notwithstanding the fact he never took office, that Congress was wrong and he really was elected.
