Indecent exposure in Washington State is very loosely defined by law:
RCW 9A.88.010
Indecent Exposure.
(1) A person is guilty of indecent exposure if he or she intentionally makes any open and obscene exposure of his or her person or the person of another knowing that such conduct is likely to cause reasonable affront or alarm.
As can be seen, it leaves a lot of space in the determination. Some people might consider it indecent while others wouldn’t. And the fact that the individual is masquerading as the opposite birth sex makes it more in the lines of purposeful exposure dedicated to being indecent because of shock value. Interesting that he is hiding behind his birth sex for a political statement.

If not, it’s not indecent exposure - but you could probably get him on some kind of dress code violation. Other than the beach or the swimming pool, going shirtless is often not permitted regardless of sex.
