The question is whether or not the statute passed by Congress that created the H-1B program authorizes the President to impose a fee that is in excess of the reasonable cost to process an application.

I don't know the answer to that. If it does, Trump is right. If it doesn't, the Chamber would be.

That is the legal question. As I recall, this question of excessive fees has been litigated before, in other contexts.
