The Fifth Amendment to the U.S. Constitution states that “No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury”. “Infamous crimes” typically refer to felonies. This requirement applies to the federal government. Federal felony charges must be brought through a grand jury indictment.

Yeah, so if they haven’t been indicted by a grand jury yet, Ratcliffe is merely hypothesizing and doesn’t really know what he’s talking about. If they HAVE been indicted by a secret grand jury, Ratcliffe is out of line disclosing that. Either way, Ratcliffe should keep his mouth shut. I’m GUESSING that Ratcliffe sees some part of the process of a grand jury indictment taking place.
