Reminder of Obligation to Protect Immigrant Families’ Rights to Access Public Education
All children in the United States, regardless of immigration or citizenship status, have a right to a free and appropriate public education.
In response to requests for information and support from local educational agencies (LEAs), the California Department of Education (CDE) is sharing resources to preserve access to education for students from immigrant families during times of increased fear of immigration enforcement.
According to data gathered by the Urban Institute, approximately half of California’s students are members of immigrant families, in which one or more parents are immigrants. One in five children in California are members of mixed-status families, in which one or more parents are undocumented. Ninety-three percent of those students are United States citizens.
Educators across California’s diverse LEAs may benefit from reviewing the resources below, which collect existing guidance about California state laws governing the protection of immigrant students and families.
- The Governor’s Office has issued a new web resource that centralizes information about protecting immigrant families, especially California’s many families who have mixed immigration status. This page includes relevant guidance about maintaining safe school environments, protecting student data, and providing access to mental health resources: https://www.ca.gov/immigration/.
- The U.S. Supreme Court has long guaranteed that all children have a right to a free public education, regardless of immigration status, per Plyler v. Doe, 457 U.S. 202 (1982). (See https://tile.loc.gov/storage-services/service/ll/usrep/usrep457/usrep457202/usrep457202.pdf.)
- Every student in California has the right to attend public school in the state free from discrimination, harassment, violence, intimidation, and bullying. (California Education Code [EC] 220, 234, et seq.)
- The threat of immigration enforcement can impair the ability of many students, including those who are undocumented and those who are United States citizens, to thrive in our schools. A 2020 Harvard report found pervasive fear of immigration enforcement in schools, resulting in increases in emotional and behavioral problems among immigrant students, reduced commitment to school and the idea of going to college, and increased absenteeism. Surveys found the threat of immigration enforcement affected US citizen students as well, as students worried about the fate of family members, friends, and classmates.
- Per Assembly Bill 699 (2017), schools are not to collect information about families’ immigration status unless required by law and LEAs must pass policies limiting assistance with immigration enforcement at public schools. - Many school districts throughout California have passed policies, procedures, and resolutions intended to make families and students feel safe at school and to communicate to staff, students, and their families that all students have a right to attend school regardless of their immigration status. Additional languages will be available in the coming days.The CDE encourages all LEAs to review and update their policies, or to adopt policies if not yet adopted, in accordance with the guidance below to ensure that they are providing safe learning environments for all students.
Specifically, LEAs should review their student enrollment, residency, and data-collection policies and practices to ensure that they comply with federal and state laws and to safeguard against inadvertently discouraging undocumented students or students from mixed-status families from enrolling in or attending school.
Staff should receive training on these policies and procedures. Staff should be advised that during the student enrollment process LEAs must verify students’ ages and residency in the district. However, school districts need not and should not ask about the citizenship or immigration status of students or their parents or guardians for the purpose of establishing in-district residency.
California law further bars LEAs from collecting or soliciting Social Security numbers from students or their parents or guardians, unless otherwise required to do so by state or federal law. (EC 49076.7[b])
Further, state law directs LEA governing boards to adopt policies that limit classroom interruptions. LEAs may adopt policies that limit access to school sites and questioning of students for immigration enforcement purposes because such activities, and threats of such activities, interfere with classroom learning (EC 32212, 35160).
Together, we will ensure that all families feel welcome on our campuses and that students feel supported to attend school. An appendix of statewide resources is attached at the end of this letter for use by educators as needed and appropriate.

shall not result in limiting enrollment access for pupils with disabilities, academically low-achieving pupils, English learners, neglected or delinquent pupils, homeless pupils, or pupils who are economically disadvantaged, as determined by eligibility for any free or reduced-price meal program, foster youth, or pupils based on nationality, race, ethnicity, or sexual orientation.

(B) If the number of pupils who wish to attend the charter school exceeds the charter school's capacity, attendance, except for existing pupils of the charter school, shall be determined by a public random drawing. Preference shall be extended to pupils currently attending the charter school and pupils who reside in the school district except as provided for in Section 47614.5. Preferences, including, but not limited to, siblings of pupils admitted or attending the charter school and children of the charter school's teachers, staff, and founders identified in the initial charter, may also be permitted by the chartering authority on an individual charter school basis. Priority order for any preference shall be determined in the charter petition in accordance with all of the following:
(i) Each type of preference shall be approved by the chartering authority at a public hearing.
(ii) Preferences shall be consistent with federal law, the California Constitution, and Section 200.

Off topic, note that California does allow charter schools to give preferences to their employees, board members, siblings, etc - it’s the most corrupt crap you’ve ever seen! Reed Hastings, the sleaze ball who started Netflix, has his very own charter school in Santa Cruz called Pacific College Preparatory which does this.
California is off the charts corrupt in every possible way.

Jack Hibbs has been talking about it a lot, even from the pulpit. There is a lot going on by churches to change things in CA.
There is ZERO chance that anything is going to change here, as long as The Invasion proceeds.
Hibbs is in a mildly Red part of Riverside County, surrounded by a sea of Mexicans. Chino Hills, Corona, Norco and all the other bedroom cities that used to be lilly White are now on their way to being just more colonies of Mexico. The west Orange County towns like Anaheim and Santa Ana are now all majority Mexican and will never be anything else.
God’s plan for Caulifonia appears to be making it the land of Spanish Catholics again, so looking forward to seeing the Inquisition start up on us Protestants real soon.

First, the above needs to be changed.
The children of illegals have a right to be educated in their own home countries. They do not have a right to be educated in the US. Home counties should be charged for the full costs involved in schooling these childfen until they and their parents can be deported.
From everything Hibbs says, they are really working hard to turn CA and their area red again and put an end to the democrat destruction of the state. He is very opposed to Newsome.
I believe this policy played a crucial role in the demographic and political change in California. Men had come to work illegally in the US for decades, but the families stayed behind. Once it was known that the kids could enroll - unchallenged - in California schools, the invasion was on. The teachers (and their unions) went along with it because the native school aged population was declining; schools were closing and teachers were losing jobs. ANY kid in a seat was money, even if they spoke no English and had little hope of doing grade level schoolwork.
Um, that’s exactly what happened. We all watched it. And now we live it.
Anaheim High School - probably 98% White in 1970 - is now 94% “hispanic”, whatever that is.
But you forgot one other component: Birthright Citizenship for the children of illegal aliens. Prior to The Invasion, probably nobody in those countries knew that their kids could end up being citizens if they just had them here. But word traveled fast in the early ‘80s and the game was on!
Trump has actually done what no friggin’ Republican has ever done before which was make a concrete attempt to change that. But we all know when it gets to the Supreme Clown Show, they will try to maintain the status quo...and claim that illegal aliens have the right to decide who “The Americans” are.
And the Southwest will become the colony of Mexico again, 180 years after they got dumped.
The other thing that happened was 'bleeding heart liberals' fixed it so illegals could qualify for 'housing, food stamps, extra help' etc. Farmers could hire them and rather than sending them home to their families after crops were picked, illegals worked the fields for 5 months and sat on taxpayers welfare for the other 7 months.
Free schooling was a part of the lager toxic incentive pattern. Today? Fewer than 3 percent of illegals 'pick crops'. Most go to democrat cities, collect benefits and work 'under the table.' - underminding wages and taking charity money designed to help Americans.
