‘He has rights’: Local couple pleads for compassion as husband faces deportation to India

MIDDLEBURG. Fla. — A Middleburg family is begging for help after they claim ICE officials are threatening the husband, who is an Indian national, with immediate deportation and criminal charges.

Tapan came to America on a J-1 visa in 2011.

It expired in 2013.

Last year, he married Ashley and they filed an I-130 marriage petition in hopes of regaining his legal status.

ICE officials arrived at their home Thursday morning demanding Tapan come outside to be taken into ICE custody for deportation.

He did not.

The family claims ICE officials told them they’d return with a warrant and charge Tapan with failure to comply with supervised release.

“And at that point, they can kick our door down and come in in front of my children and take my husband in front of them,” said Ashley. “My husband may not be a legal American citizen, but is a human being and he has rights.”

This is a show to generate anger against deporting anyone. They will focus on these non-violent cases instead of the cartel and gang banger types that are the main focus.

During the last days of the Biden administration.

This fellow ignored his 2013 expiration, stayed and then married with knowledge that his visa was invalid. Quite a guy.....

Certainly this guy has rights. He has all the rights of an Indian in India when he returns to where he belongs. So Ashley, stay in the US or go to India your choice.

Using the term “threat” is inappropriate. He violated the law. Enforcing the law is not a threat. It’s a feature.

I married my wife in 2018. She came here from Vietnam on a J-1 visa in 2016. We knew at the time that she would be required to return to Vietnam for 2 years after her (by then, an F-1) visa expired in 2024. But my health got worse over the years and we applied for a “hardship waiver” in 2022. In July 2024 the DOS denied our appeal. Two weeks later my wife was forced to leave me. We are appealing this.
Even worse, our I-130 process is taking more than a year. A month ago I suffered a fractured tib-fib and requested expedited I-130 processing. (I live alone with no other family.) Again, my request was denied.

Say what you will about illegals - but even us folks who try to do things legally are hurt badly by our immigration system.

This is a sad case, not gonna lie. But, it was our lax border control and ICE enforcement that has allowed awkward situations like this to occur. This is totally on the Democrats for creating this mess. I’m sure they are going to use situations like this to gain sympathy for the law breakers... it’s what that party does.

The situation our country is in with illegal immigration will eventually smooth out and become less emotional if we keep supporting the administration.

Natuarlly the goal is to have: an ever vigilant border control regime, swift removal of people who over stay their work or student visas and strong support for legal immigration.

They knew they were going to the residence.
They knew the guy had over-stayed his visa since 2013.
WHY THE HELL DID THEY NOT TAKE A WARRANT WITH THEM?
That is just poor planning, and worse execution.
