but where is the proof that the subordinate had been directed to sign in a specific instance.

Proof would only be required if this matter were legally challenged. In such a case, the burden of proof would initially rest on the plaintiff to demonstrate that the autopen was used without proper authorization.

That is where the courts fail us.

The reason we may not have the evidence is that the criminals were not kind enough to keep it for us!
