America’s cities have a massive crime infestation.
Without safe cities, including New York, the nation’s largest, America’s prospects are dim. Cities house over 80% of Americans, a figure that has risen steadily over time. The collective experiences of the 12 New York jurors selected to judge subway hero Daniel Penny provide insight regarding the city’s status. Penny is charged with manslaughter and criminally negligent homicide by one of your favorite president’s favorite prosecutors, New York City DA Alvin Bragg.
Juror #1 “has seen outbursts on the subway before” and “feels apprehensive about being physically threatened.”
Juror #4 ”has witnessed subway outbursts and has felt personally targeted.”
Juror #5 “has witnessed outbursts and has felt personally targeted.”
Juror #6’s “daughter was once assaulted in Times Square.”
Juror #7 “has seen outbursts.”
Juror #9’s husband “survived a street mugging . . . and said ‘Yes, of course’ she has witnessed subway outbursts.”
Juror #10 is a “woman who endured harassment on a near-empty subway car.”
Juror #11 “survived a robbery four years ago . . . he said he has witnessed outbursts.”
Juror #12 “has seen outbursts.”
Two jurors are attorneys, one female, one male. Given the facts of the case and jurors' experiences, the likelihood of Penny’s conviction seems remote. The Penny trial echoes 1987’s Bernhard Goetz trial. Goetz was acquitted by a jury after having shot four black youths who allegedly attempted to rob him on a subway. 1980s subway robberies have largely been replaced by today’s mental health cases creating their own chaos. In Goetz’s era, 38 subway crimes a day were reported and the city’s annual murder rate hovered around 2,000. Those numbers are now down to 6 and 386, respectively. Rudy Giuliani won his first mayoral election six years after Goetz’s trial, beginning the city’s crime turnaround.

You would think the jurors would be fed up with crime. Prospective jurors with worse crime experiences were probably dismissed by the prosecution. Penny is a hero.
They let out this information about jurors? I’m surprised and probably naive.
The guy should get a medal.
Penny misapplied the choke, and his actions caused the death of someone. The minute we start to accept the death of someone whether incidental or not, we are decaying the rule of law. If the law isn’t right, then get with others and get it changed. But I don’t want to hear anyone complain when their son or daughter is killed because someone made a mistake. And Penny did when he applied something and didn’t follow on to the needs of the person he choked to keep him alive. Penny is not the executioner. He could have done it right and didn’t. The law doesn’t take accident into effect.

Possible, I'd say involuntary 2nd degree manslaughter and under the conditions it would be a reduced 1-5 sentence, perhaps 1 year and out in 8 months including any time served.
...along with a government issued .45 and a suppressor with the hope he'll take it with him if he ever rides the New York City subway again.
The trial brought out that the EMTs found that the perp had a pulse.
Correctly applied, it is a carotid artery block, not an airway block.
The law does take "accident" into account when the mens rea for the crime requires certain levels of intent. Could easily have an impact on the precise crime for which he is charged/convicted.
He could have done it right and didn’t.
Assuming that is correct, what would you say is the reason he didn't do it "right"? A jury could find that even if he did not perform the action correctly, he did it in good faith, and there were exigent circumstances that justified him taking action versus remaining seated because he didn't have perfect knowledge of the technique he employed.
Why the bloody hell does the prosecutor think he has to accept these 12 jurors?
Was the entire jury pool filled with people who have been assaulted on the subway?
I would vote to acquit, and I say that as a former police officer, military officer and attorney. If no one agreed, it would be twelve angry men. The person he choked had threatened others on the subway and needed to be controlled. I will not second guess that Marine’s judgment. He walks (and maybe gets a medal).
Jordan Neely was saying that he was not afraid of going to prison and was ready to die, and threatening people.
In most states lethal force is justified if a person fears death or grave injury to themselves or to others. It does not even seem Daniel Penny intended to use lethal force, but it would be justified in most states in this situation. And Penny tried to tend to Neely when he quit fighting. I think I read that Neely was still alive when paramedics arrived. I have not seen any reporting on a toxicology exam, but knowing of Alvin Bragg’s reputation I would not doubt that exculpatory evidence is being withheld. And whatever the other evidence, I think Neely brought this on himself.
Probably assaulted or witnessed assaults. Alvin Bragg would not have let these jurors be accepted if there were more favorable jurors out of (who knows how many) the total called up.

In addition to the number of victims, there are an inordinate number of people who can't serve on a jury in New York City due to their criminal records and/or because they're illegal aliens.

You can thank Governor’s Mario and Andrew Cuomo for dumping psychiatric center residents out on the street in order to use that money for liberal BS. They wouldn’t admit it was the reason, instead claiming the patients could get better treatment in the community. That didn’t work out well, because they began showing up in New York State’s prison system. The State then renovated some of the psych centers into prisons. I worked in one until I retired in 2003. Andrew Cuomo and Kathy Hochul then commenced to close prisons claiming crime was down, which we know isn’t true. Instead, it’s being done to use that money on their BS projects. Six prisons were previously closed when Cuomo was still in office. Hochul just closed two more prisons in Elise Stefanik’s district, one being a maximum security prison. She filed a complaint with the Governor’s office over it.
Accepting the rule of law shouldn’t be a suicide pact. The dead guy was clearly threatening the other passengers and was in a position to act upon his threats. Any law that would punish Mr. Penny is corrupt. Advocating for his punishment because a bad law hasn’t been fixed and hiding behind “the rule of law” isn’t righteous it’s cowardly.
