Will it then be up to Speaker Johnson to do it?

So what I’m gathering from all these responses is that Mike Pence couldn’t have stopped the certification of Biden.

If Kamala for WHATEVER reason decides to not certify, the electors must return to the state until that (those) state legislatures convene to confirm (certify) them as legitimately elected OR appoint new ones.

She has no absolutely no power to make such a decision, and there is no mechanism for the Electors to go back to the states once the certification deadlines have passed and the Electors have cast their votes.

If Electors are disqualified, that would have to be done by vote of Congress to prevent them from being counted. If once the count of accepted Electors does not equal a majority for either candidate, the House elects the President and the Senate elects the Vice President.

Nope. The VP, whoever it is, has no such authority under the Constitution, the law, or Congressional rules to do so. Only a Congressional vote passing to block the counting of Electors - passing in both chambers.

Even if in theory the VP could have made their own motion, it could have been merely overruled quickly by appealing the ruling of the chair.

In today’s America, we know that “the law” means “what you can get away with”. While I agree with your points completely, having Congress reiterate that the VP has no role in the certification is a good thing. Further, it will clearly juxtapose what might be attempted by the Dems against exactly what they railed against 4 years ago. This alone will diminish “what they can get away with”.

Do you even TRY to understand this issue? The whole process is perfectly clear, read Article II and Amendments XII and XX.

Electors are appointed by State Legislatures. This was decided in 1788. This is a sole, sovereign power of State Legislatures (and Congress, which unwisely was granted 3 Electors in 1960 by Amendment XXIII). All State Legislatures currently use people voting to accomplish this purpose.

Those Electors meet in their State capitals, all on the same day (December 14 in 2020) and cast their votes, sending them sealed to the Seat of Government of the United States addressed to the President of the Senate. On a fixed day, in January since 1936, the votes are opened and COUNTED.

The body that does the counting is a unique, special joint session of Congress with all Senators and Congressmen in the room, each with one vote (535 total), normally with the President of the Senate in the chair.

Now, in 1845, 1853, 1870, 1885, 1905, 1925, 1949, 1953, and 1965 the office of President of the Senate was vacant, and in other years Presidents of the Senate have declined or been unable to chair the meeting, so the President of the Senate (Vice President) is by no means critical to the process, the Special Joint Session could elect its own presiding officer.

But here's the key thing. The Special Joint Session exists SO THAT THE VOTES COMING FROM THE STATE CAPITALS CAN BE COUNTED IN PUBLIC, WITH ALL PARTIES OBSERVING. There are rules for objections, whch require one Senator and one Representative to file an objection with the chair, in writing. The chair can then RULE on the objection, or send it to the House and Senate for debate and a vote.

But ALL rulings of the chair are subject to appeal to the House and Senate.

So now we come to Mr. Pence. He WAS President of the Senate, and he DID chair the Special Joint Session on 1/6/21. He was empowered to hear and rule on objections to various States' Electoral votes. There were two valid objections (Arizona and Pennsylvania), and he did submit them to the House and Senate, where they were rejected by huge majorities.

But, you say, he could have rejected them on his own, right? Yes he could have, BUT, his decision would have been immediately appealed to the same Congress which voted down the only two valid objections (Arizona and Pennsylvania) by votes of 6-93 and 121-303 (Arizona) and 7-92 and 138-282 (Pennsylvania).

The Congress which assembled on 1/6/21 to witness the counting of the votes had only 7% of the Senate and 31% of the House in favor of the objections - which meant that there was NO POSSIBILITY of that process producing a Trump victory.

“...They would have purged the military of patriots and then authorized the military to fire on US citizens....”

Yes, but; the members of the military (not generals & admirals) and police (not police chiefs) I have met are more for Trump than for Harris. If what you hypothesize were to occur, I would expect most of the “tip of the spear” military would refuse the unlawful orders.” Yes, that would be chaos and crazy times. However, I would expect the US Supreme Court to step in quickly and provide some harsh direction. Neither Biden nor Harris are commander in chief inspirations.

“Would it surprise anyone if the democrats do cause a full on constitutional crisis? Perhaps even a 2nd civil war?”

It would surprise and shock me if the Marxists allowed a peaceful transfer of power to their opposition, the Trump GOP. I’m expecting pretty much ‘anything’ from this point on.

There is a disturbing rumor afloat today that some 31 MILLION Evangelical Christians will NOT VOTE on 11/5/24!
I’m reminded of a joke so old that, when I first heard it, I kicked the slats out of my crib over 75 years ago Even if you’re heard it before, please resend it in hopes it reaches enough others to make the critical difference.

A man was caught in a raging flood & forced to seek safety on the roof of his home as the water contined to rise.
Soon a man in a boat came by & urgd him to get in. The man replied: “The Lord will save me” & waved him off.
The water rose higher & another boat drifted by & he again declined, & declared “The Lord will save me.”
This repeated 3 times until the water rose OVER the roof & the man drowned!
Upon reaching the pearly gates, the Lord greeted him & the man asked Him why He failed to save him.
The Lord replied, “My son, I sent boats for you but YOU REFUSED TO GET IN!”

What does this have to do with the most critical national election in our history?
EVERYTHING!

Given the incredible volume of information concerning the FLOOD of corruption, sinful behavior (pedophelia, bribes, theft & yes, murders! etc.) within some ranks of the political class (ESPECIALLY THE DEMOCRATS!), think of TRUMP as one of those boats. If you can think of WHY a 70 year old man worth $3 BILLION at the time would subject himself to what Satan & his minions have heaped upon TRUMP & his family, share it with us!
ALL THAT COMES TO MY ALLEGED MIND IS:
LOVE OF COUNTRY!

Yes, love of country... and earlier interviews with Trump have clearly shown that love. In the meantime, I think he has truly found God (and vice versa).

A lot of the evangelicals are not voting because they listen to lying false prophets that have been telling them don’t worry, God’s got this, and God said that He is going to “blah blah blah”, so they figure they can just sit home and do NOTHING.

These false liars in God’s name tell these evangelicals that so they will “feel good” and comforted enough to keep donating to their grifting @’s. Those evangelicals are going to be real surprised on Judgement Day when they are reminded of that “itching ears” warning in the Bible that they chose to ignore. Notice that I call them “evangelicals”... not Christians... for good reason.

Well, I’ve done the best I can. What are you going to do?

I'm currently doing much more than I can talk about on this forum.

If the Democrat cult really believes that Trump is disqualified by the 14th Amendment, if they really believe he’s a threat to democracy, if they really believe he’s a Putin asset, if they really believe that he’s essentially Hitler,

then they have a moral and legal obligation to stop certification.
