CHICAGO — A repeat felon on pretrial release for a Class X felony gun crime escaped from electronic monitoring and viciously attacked and robbed a 92-year-old man at an Englewood ATM last week, prosecutors said.
D’Marco Roby, 26, had been held in jail for the pending armed habitual criminal case. That ended on February 24, when Judge Laura Ayala-Gonzalez, reviewing his pretrial conditions under the SAFE-T Act, rejected the state’s request to keep him in custody and sent him home on an ankle monitor, court records show.
An escape warrant went out for Roby on July 3 after he allegedly left the home where he was supposed to be on house arrest and never returned.
A few weeks later, on July 31, Roby and an unknown accomplice watched as a 92-year-old man withdrew money from an ATM at Citgo, 251 West 63rd Street, officials said. After the victim completed the transaction, Roby and his partner moved in.
