President Biden's decision to end his reelection campaign leads to questions about election law and the ability for the Democratic Party's nominee to appear on ballots in all 50 states. David Becker, executive director of the Center for Election Innovation and Research, joined CBS News to talk about that.

This guy on CBS says the new candidate can be on the ballot of all 50 states. He/she either can or can't. Mike Johnson says otherwise. Who's right?

I think he'll show up on all ballots. Convention hasn't started yet and that's when the candidate is nominated. Splitting' hairs? You tell me.

Law? For Democrats? There is no law when it come to Democrats. They will find a tame judge to say what ever they do is fine.

He left on March 31st 1968 after the NH primaries. He as not candidate elect like Biden. This is brand new ground

I would question which State Legislator or judge would be able to enforce the law. The legislators did not step in during 2020 when the election was stolen, so I have little faith that the current laws will be enforced.

I’m wondering about the Texas 18 seat. The incumbent, Sheila Jackson Lee, died in office, died a couple of days ago.

She had won the primary. She is listed as on the ballot. Can they do a special election before November? It looks to me that either the Democrats have to elect a dead woman or the Republican is running unopposed.

I think the SC made it clear when Dems tried to run Trump off the ballot in CO that they are biased towards elections happening. I suspect that legal wrassling will result but in the end they will allow the Democrats to run someone.

I believe this guy more than Mike Johnson, who is a politician trying to get some cheap points and get the base excited about something that he probably also knows is not going anywhere. The Dems will get who they nominate during their convention, and no frivolous GOP lawsuit will change that. However, if there is chaos at the convention, that will help the GOP much more than any lawsuit would.

There is no such thing as “candidate-elect”. Primaries have become the accepted way for parties to choose candidates, but there is no legal or constitutional requirement for them to do so. As a matter of fact, historically it is a relatively new phenomenon for the public to have a voice in selecting the candidates for president. Well into the 20th century, the “smoke filled room” was the way candidates were selected. There is no nominee for president for a party until the party designates one according to their own rules, regardless of how many people voted in primaries.

All of that is to say there is absolutely no issue with whomever the Dems select at the convention from being on the ballot in all states. If it is not Kamala, there is an issue with the money raised already for Biden, but that is another subject.

The Democrats were headed towards a brokered convention in 1968 when Robert Kennedy was assassinated. Humphrey was the last man standing despite some last minute attempts to hijack it by George McGovern. The other candidate Eugene McCarthy had very little support.

Interesting bit of trivia. McCarthy and Humphrey were both from MN

I think they will call the seat vacant. The next date for a special election is the November election.

They will likely reopen the race as an open election.

Every 4 years they talk about the possibility of a brokered convention. That would tear them apart as nobody likes Kamala. We can hope.

Colorado couldn’t keep Trump off the ballot. If Ohio refused to let Biden on their ballot we’ll never know how it would turn out. I’m sure if the tables were turned the rats would do what they do.

Horace Greeley died in 1872, after the election (?) but before the electoral college met. Most of his electoral votes went to B. Gratz Brown, his VP candidate, with VP votes scattered among other candidates.

Looking back, when McCain and then Romney won , you’d say primaries are pretty much for show. Biden ‘20 really showed that.Trump ‘16 was the exception, maybe Obama ‘08
