SCOTUS must act to remain relevant
7thof7th

Posted on 05/31/2024 2:44:55 PM PDT by 7thOF7th

If the SCOTUS does not intercede in this abomination of a judicial process, why do the American people even need a SCOTUS? What role do they play in a post-America where justice is served at the whim of political activism? It seems to me that to preserve their relevance, SCOTUS must be heard!

Trump can still be elected while in jail...unless they have him “taken care of” there.

“None of this gets solved until there is a new political structure in place.”

A new political structure. Sorry but that isn’t going to get it done. The democrats, media have to be fully investigated for the atrocities they have committed in this country. They have to be held accountable, charged and imprisoned. For the border, the J6 atrocities, the political assassination of Donald Trump who was fairly elected by the American people and this recent court scam, conducted by the White House.

Well, if he hires Dershowitz and Turley caliber attorneys and constitutional experts, maybe. Put together an OJ-like dream team. And I don’t know who that might include except not Giuliani and company.

They’ll act on Nov 6th or the day after Trump is murdered. If they were useful today would have been the day they reversed it. Thry should have been getting daily transcripts and they should already know every detail of the case....Kind of a big deal.

In a sane world, there would be.

If that idiot Bush Nominee Roberts doesn’t understand, He will be out of a job sooner than later, and probably in jail. The Democrats are openly saying they will bury the Supreme Court.

Fine. Then enjoy your next atrocity. And the next one. And the one after that...

The Supreme Court is still smarting from the criticism it received after it stopped the recounts in Florida in December 2000, even though that was necessary and justified (the recounts finally did show that Bush won Florida, but it took until after Jan. 20, 2001, to complete them, and the media ignored the final results).

So they will be very reluctant to do anything that might help a Republican nominee (as they showed in 2020). But maybe if Merchan orders Trump to prison they might feel forced to do something. But only maybe.

I don’t enjoy any atrocity, but changing the political structure is nonsense. These people need to be held criminally accountable until anything changes. So what would your new “political structure” consist of?

This is bigger than Trump. Scotus must intervene. Our Right to vote is in jeopardy! What choice do we have?

I read somewhere not long ago that SCOTUS has the Constitutional authority (and responsibility) to supersede the lower courts of appeal and take on such travesties of justice. Does anyone know if this is true??

If so, I would expect the Trump attorneys to have already prepared the required paperwork and ready to file at first appropriate moment.

Someone has to bring forth the case first.

The US Supreme Court won’t take this up now, it is not ripe for them.

I disagree on this point, as I've discussed in length in my posts on another thread here, here, here, and here. I won't repeat them all here.

In short, the ripeness is the interference with the RNC National Convention where Trump is to be formally nominated. It's no coincidence that Merchan chose the sentencing date to be just before the convention when it would not have mattered to "justice" if he waited two more weeks. That's about six weeks away.

In this case, SCOTUS would have original jurisdiction:

Article III Section 2

In all Cases affecting Ambassadors, other public Ministers and Consuls, and those in which a State shall be Party, the supreme Court shall have original Jurisdiction.

I would think that "The People of the State of New York v. Donald J. Trump (IND-71543-23)" would qualify for an original jurisdiction hearing by SCOTUS.

Trump could argue that his fifth and sixth amendment protections were violated by the district attorney and the trial judge in order to convict him and sentence him in such a way as to prevent his nomination in July, which has national impact.

That's pretty ripe right now with the clock ticking to July 15.

“Expecting it to now meticulously folow all of the standard rules and percolate through the NY state appeals process in order to eventually (maybe) make it to the Supreme Court in 5 or 6 years is ridiculous. The Supremes ought to swoop in and just end this farce.”

They never swoop in. Cases are brought to them. Trump can submit an Emergency Appeal to the federal circuit judge.

I appreciate your enthusiasm for the best aggressive Trump legal team possible. I do not believe it would have made a difference e against a demonstrably bent judge and deranged anti Trump jurors. Outcome same.
This system depends upon honor or people doing the right thing and being too ashamed to do the wrong thing much. That isn’t our society now and it shows.

Some of you FReepers crack me up. Do you really think your problems will be solved by lawyers arguing in a court?

Does anyone truly not think that in today's failing banana republic Democrats won't simply ignore SCOTUS rulings that they don't like?

"Trump's court is illegitimate! Disregard all of it! Let his judges enforce it!"

“An emergency intervention by the SCROTUS is needed NOW, not AFTER the election!

Act NOW, SCROTUS!”

Name a time when the USSC intervened in a case that was not brought to them?
