Merchant made an unexpected appearance at the Fulton County Courthouse on Monday afternoon to defend another Atlanta-based attorney who, in a shocking twist, was arrested while in court.

Monday’s developments sent shockwaves through Atlanta’s legal community, and a group of [25] criminal defense attorneys showed up in support of [Defense Attorney Brian] Steel, including Merchant, who chairs [President of] the state’s criminal defense attorney association.

On Monday, [Defense Attorney] Steel requested a mistrial after telling the judge: “You’re not supposed to have communication with a witness who’s been sworn.”[aka, ExParte]
In response, Granville demanded to know how Steel learned of what was said in that meeting, and when the defense attorney refused to disclose his source, Granville had Steel arrested and ordered him to spend the next 10 weekends in jail.

Granville’s decision to put Steel behind bars stunned many lawyers. Merchant told the judge on Monday that about 20 to 25 other lawyers came with her to the courthouse to support Steel. On X, formerly Twitter, Georgia-based criminal defense attorney Andrew Fleischman commended Steel as “a goddamn lawyer’s lawyer,” while attorney Scott Greenfield applauded for having the “fortitude” that “every criminal defense lawyer should have.”

“Brian Steel is one of the most reputable lawyers you will ever find,” conservative legal analyst *Phil Holloway* wrote. “Judges can’t just jail lawyers for doing their job Judges can’t have secret meetings with DAs either.”

Georgia-based criminal defense attorney Ben Mozingo added,
🔥 “Brian Steel just asked if he could be housed with his client while he’s in custody on his criminal contempt🔥 so they can prepare for trial. This guy is so good it’s hard to articulate.”

After the judge held [attorney] Steel in contempt, he asked Granville if he could spend the weekends with his client at the Cobb County Jail instead so that they could work on their case. The judge said he was OK with that and would speak with the sheriff.

Ashleigh Merchant is such a good lawyer that she explained the issues very clearly so even this non-lawyer could grasp the legal arguments. I think she had to break it down to its most essential elements because the judge is as thick as two planks and was unable to understand the difference between civil contempt and criminal contempt.

For those who can’t or don’t want to watch the video, a defense lawyer learned that the judge on his case had a two-hour meeting with the prosecution and one of their witnesses, and the defense was not told of the meeting or invited. These ex parte communications are illegal and grounds for a mistrial and removal of the judge from the bench. The judge seemed unvexed and even detached from the fact that he committed a crime by having the ex parte meeting.

Instead, the judge demanded that the defense lawyer TELL HIM who told the lawyer about the meeting. He added that if the lawyer didn’t tell him who gave him the information, he’d be held in criminal contempt of court and be jailed until he cracked. Criminal contempt has certain procedures and penalties, and Ashleigh tried to correct the judge that it was actually civil contempt, which didn’t warrant jail time and had different procedures. She also told the judge that if the lawyer were to reveal the information the judge wanted, he could be disbarred for breaking attorney-client privilege. None of this registered with the judge. Unbelievable!

Oh how I’d love to read Cboldt’s thoughts on this matter now.

The presenter of that video gives a really good summary at the end, where she says that the “little people” have been suffering injustice and lawlessness at the hands of this corrupt system all along, and it’s only being exposed now when there are people like Trump who can afford good attorneys who won’t let the system railroad them.

What we’re seeing is how Fani Willis and the whole system is screwing the people of Fulton County - and has been doing so for years.

This is why Trump is the champion of the “little man”, and that includes a lot of Blacks in Fulton County and elsewhere. This really needs to be emphasized so that Blacks can see the difference between those who need them to stay on the plantation while Massah repeatedly rapes them, and those who genuinely want justice and due process.
