If Roker's company never contractually agreed (did he?) to PBS's DEI "mandate," he's not bound by it.
If PBS never contractually agreed with the plaintiff, or plaintiff's union, to impose the mandate on anyone -- if it was only a general desire to increase DEI -- then PBS is not bound by it.
