This seems to be a big Democrat talking point right now.
The 14th Amendment seems to speak of “engaging in insurrection”.
It doesn’t mention a charge, a trial, or a conviction.
The Democrats are interpreting this as “if someone is of the opinion that you have “engaged in an insurrection” then that’s all we need and you cannot seek any office ever again”.
I’m pretty sure the Supreme Court will consider this a bit too sweeping.

Indeed, the rats are trying to get the MSM/uniparty/nevertrumpers to pick up and run with the ball as they’ll try to desecrate him for the next 5 years. When Trump wins this fall the MSM will start with ‘illegally elected’ and carry it on as long as we live.
The 14th Amendment expressly provides that “Congress shall have power to enforce, by appropriate legislation, the provisions of this article.” States were not granted enforcement power. Has Congress enacted any legislation to enforce the 14th Amendment?

Right but I think the context was that it could be so obvious to be undeniable, such as a confederate military officer who wasn’t formally charged with a crime. I don’t think anyone would be able to rationally argue against that even without a criminal trial.
