Penal Code ยง 459 PC defines the crime of burglary as entering a residential or commercial structure (or locked vehicle) with the intent to commit grand larceny, petit larceny, or any felony offense. You can be charged with burglary even if there is no forced entry. In California, burglary can be charged as a felony or a misdemeanor.
