It’s an interesting point on land ownership. While there is fee simple ownership (fee hold) just like we have in the continental US there is also a large amount of leasehold property. There are (were?) multiple properties with condominium complex sitting on them which are leasehold.

Prior to his passing last year my Brother lived in Lahaina for over 25 years working as a real estate agent and commercial property manager. He had pointed out to me that several of the leasehold were coming to the end of their term. The families that actually own the land these condominiums sit on had seen their grandparents/great grandparents grant the lease hold for peanuts many decades ago.

These condo complexes are worth tens of $ millions but don’t own the land they are built on and the families that own it, who had been rebuffed at every request to renegotiate the leasehold terms, were in essence going to build the ‘back payments’ they felt due into any new lease hold agreement. The condo complexes have little choice but to pay; the alternative is to either walk away or tear down the complex and return the property to the
condition prior to the leasehold being granted.

I have no idea how the fires and the property loss would impact insurance payments under those circumstances; some of the lease holds expire next year and more to follow within five years.

I listened to the Hawaii Real Estate Youtube channel this evening with some updates. He’s been doing a good job of updating on what is going on in Maui. He had a local they call Fish on again with some more details on the fire.

He was the one who was there when the police were blocking the road not letting people in cars get out. He asked them why & the officer told him he was just following orders to block the road.

There were stories about power poles being down as to why but Fish said he couldn’t see any down as far as he could see. They both were real skeptical about why they blocked the cars. He did say many of those people stuck behind the blockade died, but those who drove around them got to safety & survived.

Here is some info I wasn’t aware of. Now I did know the police chief was the same one who handled the Las Vegas massacre. What I didn’t know was he had only been police chief for over a month. Fish said this police chief was also the coroner. Both of them said that was against the local laws. Both seemed to think so much of the tragedy had a coordination to it.

I’m beginning to think the police chief is a deep state fixer. Then you have the questions of how the media & government is handling/mishandling it all. I hope something blows this whole thing wide open.

Then there is the whole issue with the water rights. The water was due to be renegotiated on August 7th. The fire happened THE NEXT DAY. This is according to the lawyer Kapua’ala Sproat. Look up her videos on Lahaina. The timing on all of this is super suspect.

Interesting point indeed. I left Hawaii fifteen years ago and had forgotten that much, if not most, of the land in Hawaii is leasehold. Acquiring fee simple land was a big deal. Puts a new spin on things.
