He knew there was fraud and if he sent EC votes back to state legislatures for further review, 12th Amendment would’ve kicked in where GOP House of Reps would’ve voted for Trump

This is also why the Electoral College Act was amended last year - to make sure no VP could send fraudulent votes back to states
Pence had the ability to do so in 2020 but he backstabbed 74+ million voters like the RINO coward he is

JMO but an act of Congress does not change the Costitution. Neither this act nor the previous act from the late 1800s governing VP powers and duties were of any affect since the Constitution was not amended.
The powers of the VP are exactly as spelled out in the Constitution, the other actions in this and previous laws have not been used therefore not challenged in the USSC. These acts of Congress are IMO eyewash and cover for VP and Congress failing to due their duties under the Constitution they have “support and defend against all enemies both foreign and DOMESTIC”
