Turley: Jack Smith Needs More Evidence Than Trump's Speech To File J-6 Charges

FOX News legal analyst Jonathan Turley comments on reports that former President Trump will be indicted again over his actions or nonaction around January 6, 2021:

"JONATHAN TURLEY: This is a step that usually will come towards the end of an investigation when you receive these types of letters, it gives your client the opportunity to appear in a grand jury. They are never a welcomed thing to receive. Usually, a target letter is before you receive an indictment, that's not necessarily the case. But it is viewed that way by most criminal defense attorneys. These letters often tell the target that they need to preserve evidence, that they need to look at counsel. That they have a set period of time where they can appear before the grand jury.

The concern here is that the special counsel could be proceeding on a case that might be constitutionally challenged. If the case is built around Trump's speech on the on the ellipsis on Janua 6, I don't believe that it could withstand judicial review. The question is, does Smith have something else? Something that's a direct link to a conspiracy or effort to cause violence? We haven't seen that. The January 6th committee in Congress came up with nothing as a direct nexus to that type of evidence."

“Jack Smith will do or say or charge anything that he wishes and there is nothing that anyone can do about it.

Sounds like Jack is controlled by his emotions, doesn’t deliberate as the political and constitutional gravity of his potential actions beyond the scope of his office, is very impulsive and undisciplined .... traits that I see some other FREEPers now ascribe to Trump.

Oh how naive of you to not even look at the history of Jack Levinsmith (Smith). He prosecution and conviction of VA Governor Bob McDonnell was overturned 9-0 by SCOTUS, you have to be a stupid and overzealous prosecutor to have that happen to you. This Jack Smith has a reputation of abusing statutes with scant evidence.

Prosecutors in war crimes trials are lawyers NO ONE in the US will touch.

Your scenario raises many constitutional issues, including separation of powers. Pence would never take the stand. But we live in a post Constitution Anerica, so I won’t totally eliminate your scenario.

The written record stands on its own - I am unaware that the issue of fraudulent MI electors was raised in Jan 2021 electoral proceedings at which the master of ceremonies Pence was carrying out merely administrative tasks .... before the subsequent demonkkrap congress passed a “law” enshrining the VP’s duties as merely ceremonial.

BTW - I disagree with Turdley if he thinks Trump’s speech contains some evidence, though insufficient, to file charges against Mr Trump. That speech does exactly the opposite.

Jack Smith is the sword that is held by the men who deal with those who quote laws.

Pretending that we still live in a constitutional republic with laws, traditions and enlightened societal norms is a very foolish thing.
